2 Transport Infrastructure (Roads) Amendment (No. 3) No. 289, 1992 ˙ Short title 1. This regulation may be cited as the Transport Infrastructure (Roads) Amendment Regulation (No. 3) 1992 . ˙ Amended regulation 2. The Transport Infrastructure (Roads) Regulation 1991 is amended as set out in this regulation. ˙ Amendment of s.4.16 (Renewal of registration) 3. After section 4.16(e)— insert — ‘ (f) the inspection fee payable under section 29(3) of the MotorVehicles Safety Act 1980 ; ’. ˙ Amendment of s.4.32 (Penalty notices) 4.(1) Section 4.32(1)— omit, insert— ‘(1) An authorised officer may serve a penalty notice if the authorised officer believes on reasonable grounds that an offence against a section set out in column 1 of Schedule 3 or 4 has been committed. ’. (2) Section 4.32(3)— omit, insert— ‘(3) The prescribed penalty for an offence against a section set out in column 1 of Schedule 3, according to the percentage of mass by which the prescribed mass is exceeded as set out in column 2, is the corresponding amount set out— (a) in column 3 for a first offence; or (b) in column 4 for a second offence committed within 5 years after the commission of the first offence; or (c) in column 5 for a subsequent offence committed within 5 years

3 Transport Infrastructure (Roads) Amendment (No. 3) No. 289, 1992 after the commission of a second or subsequent offence. ‘(3A) The prescribed penalty for an offence against a section set out in column 1 of Schedule 4 is the corresponding amount set out— (a) in column 2 for a first offence; or (b) in column 3 for a subsequent offence committed within 5 years after the commission of another such offence. ’. (3) Section 4.32(8)— omit, insert — ‘(8) For the purposes of determining if a second or subsequent offence has been committed, an alleged offender is taken to have committed another such offence on the day on which— (a) the prescribed penalty for the offence is paid to the Corporation; or (b) the alleged offender is convicted of the offence. ’. ˙ Replacement of Schedule 3 (Penalties) 5.
