s1 2 s6 Transport Infrastructure (Roads) Amendment No. 138, 1997 (No. 1) ˙ Short title 1. This regulation may be cited as the Transport Infrastructure (Roads) Amendment Regulation (No. 1) 1997 . ˙ Commencement 2. This regulation commences on 1 July 1997. ˙ Regulation amended 3. This regulation amends the TransportInfrastructure(Roads)Regulation 1991 . ˙ Amendment of s 12 (Use of vehicle on road) 4. Section 12, before paragraph (a)— insert— ‘(aa)under section 16(2) 1 ; or’. ˙ Amendment of s 15 (Exemption from payment of fee) 5. Section 15(1)(a)— omit, insert— ‘(a) a vehicle owned by an association established solely for a charitable purpose within the meaning of the Collections Act 1966 and used solely for the purpose; and’. ˙ Omission of s 21 (Carrying of certificates of registration) 6. Section 21— omit. 1 Section 16 (Inspections)
s7 3 s7 Transport Infrastructure (Roads) Amendment No. 138, 1997 (No. 1) ˙ Amendment of s 22 (Attachment of registration labels) 7.(1) Section 22(1)— omit, insert— ‘ 22.(1) The owner of a registered vehicle must attach the registration label issued for the vehicle to the vehicle— (a) for a label issued on initial registration—within 21 days after the application for registration is made; or (b) for a label issued on an application for renewal of registration— (i) if the label is issued before the registration expires—within 21 days after the registration expires; or (ii) if the label is issued after the registration expires—within 21 days after the application is made; or (c) for a replacement label— (i) if the label is issued on an application for a replacement label—within 21 days after the application is made; or (ii) if the label is issued under section 27(3)—within 21 days after the owner notifies the chief executive under section 27(2).’. (2) Section 22(2)(c), after ‘6 m from’— insert— ‘the front or left-hand side of’. (3) Section 22(4)— omit, insert— ‘ (4) The owner must remove the label from the vehicle and destroy it immediately either of the following events happens— (a) a registration label later issued for the vehicle is attached to the vehicle in accordance with subsection (1)(b) or (c); (b) 21 days expires after the end of the period of registration to which the label relates.’.
s 8 4 s 10 Transport Infrastructure (Roads) Amendment No. 138, 1997 (No. 1) ˙ Amendment of s 23 (Attachment of number plates) 8.(1) Section 23(1)— omit, insert— ‘ 23.(1) The owner of a registered vehicle must attach a number plate to the vehicle within 1 day after receiving— (a) for a number plate issued for the vehicle—the plate; or (b) for a personalised number plate—a certificate of registration mentioned in section 25(6)(b).’. (2) Section 23(2), ‘visible’— omit, insert— ‘legible’. ˙ Amendment of s 27 (Change of particulars on register) 9.(1) Section 27(1), ‘written’— omit. (2) Section 27(1)— insert— ‘ (1A) For a change of name, the notice must be written.’. (3) Section 27(3)— insert— ‘(c) if the details on the registration label issued for the vehicle have changed—issue a replacement registration label.’. ˙ Amendment of s 28 (Renewal of registration) 10. Section 28— insert— ‘ (4) Despite subsection (1), the chief executive may accept an application for renewal of registration at any time.’.
s 11 5 s 12 Transport Infrastructure (Roads) Amendment No. 138, 1997 (No. 1) ˙ Amendment of s 29 (Transfer of registration) 11.(1) Section 29(1), after ‘A person’— insert— , or the agent of a person,’. (2) After section 29(1)— insert— ‘ Example— A dealer who sells a registered vehicle to a person and accepts from the person any amounts mentioned in subsection (2) is the person’s agent. ’. ˙ Amendment of s 31 (Cancellation of registration) 12.(1) Section 31(2), ‘is not made in accordance with section 28.’— omit, insert— ‘is— (a) refused under section 18; or (b) not made in accordance with section 28.’. (2) Section 31(4), ‘receiving notice of cancellation from’— omit, insert— ‘being served a notice of cancellation by’. (3) Section 31(7)(a)— omit, insert— ‘(a) in the case of the owner’s application— (i) for an application under subsection (1)(a), (c) or (d)—on the date of receipt of the application and compliance with subsection (4); or (ii) for an application under subsection (1)(b)—on the day after the vehicle is reported as stolen to the police service or is destroyed; or’.
s 13 6 s 16 Transport Infrastructure (Roads) Amendment No. 138, 1997 (No. 1) ˙ Amendment of s 35 (Limited use plates) 13.(1) Section 35(7)— omit, insert— ‘ (7) On the sale or other disposal of a vehicle to which a limited use plate is attached, the owner of the vehicle must— (a) remove the plate from the vehicle; and (b) apply to cancel the authority to use the plate.’. (2) Section 35(10) ‘receiving notice of cancellation from’— omit, insert— ‘being served a notice of cancellation by’. ˙ Amendment of s 39 (Cancellation of dealer’s plates) 14. Section 39(5), ‘receiving notice of cancellation from’— omit, insert— ‘being served a notice of cancellation by’. ˙ Amendment of s 49 (Offences) 15. Section 49(3)(c)(v), ‘the register’— omit, insert— ‘a register’. ˙ Amendment of sch 1 (Fees) 16.(1) Schedule 1, part 1, section 1(c), after ‘cylinders’— insert— ‘or 3 rotors’. (2) Schedule 1, part 3— insert—
s 17 7 s 17 Transport Infrastructure (Roads) Amendment No. 138, 1997 (No. 1) ‘ 4A. Accessory number plate with the same number as a personalised number plate . . . (3) Schedule 1, part 4, section 2(d)— omit, insert— ‘(d) extract for use in a vehicles safety recall . 17.00’. 1.00 to a maximum of $5 000’. ˙ Amendment of sch 2 (Number plates) 17.(1) Schedule 2, column 4, heading, ‘Visibility’— omit, insert— ‘Legibility’.
