Short title 1. This regulation may be cited as the Transport Infrastructure (Roads) Amendment Regulation 1991 . Amended regulations 2. The Transport Infrastructure (Roads) Regulations 1991 are amended as set out in this regulation.

2 Transport Infrastructure (Roads) Amendment Regulations 1991 Nomenclature of provision units 3.(1) A provision of the Transport Infrastructure (Roads) Regulations 1991 that was, immediately before the commencement of this section, called a regulation may be called a section. (2) A provision of the Transport Infrastructure (Roads) Regulations 1991 that was, immediately before the commencement of this section, called a subregulation may be called a subsection. (3) A reference in the Transport Infrastructure (Roads) Regulations 1991 to a regulation or subregulation of the regulations designated by a number is a reference to a section or subsection of the regulations designated by that number. Replacement of s. 1.01 (Short title) 4. Section 1.01— omit , insert — ‘Short title ‘1. This regulation may be cited as the Transport Infrastructure (Roads)Regulation 1991 . ’. Amendment of 5. 1.02 (Definitions) 5. Section 1.02 (definition “weighing device” )— omit . Amendment of s. 2.02 (Damage to road transport infrastructure) 6. Section 2.02(2)— omit , insert — ‘(2) A person must not use, or permit to be used, on a declared road, a vehicle or other kind of equipment that is not fitted with pneumatic or rubber tyres, except—

3 Transport Infrastructure (Roads) Amendment Regulations 1991 (a) under a permit issued by the Corporation; or (b) for the construction of works for, or maintenance of, road transport infrastructure. ’. Amendment of s. 2.08 (Regulation of animals on declared roads) 7. Section 2.08(3)— omit , insert — ‘(3) A person must not allow an an1mal to stray onto or graze on a declared road that has a substantial fence on both sides, unless the animal is being moved under— (a) a permit issued under this regulation; or (b) the Rural Lands Protection Regulations 1989 .’. Amendment of s. 3.03 (Axle mass) 8. Section 3.03 (heading to Part A of Table)— omit , insert — ‘PART A—CONFORMING AXLE GROUP MASS’. Amendment of s.4.32 (Penalty notices) 9. After section 4.32(16)— insert — ‘(17) In addition to the prescribed penalty, a penalty notice may also advise that an amount (determined by the Corporation), up to but not more than double the amount of any fee or fees due for any purpose under the Act, may be paid within the time specified for payment of the prescribed penalty without involving Court proceedings. ’.
