s1 2 s3 Transport Infrastructure (Railways) Amendment No. 66, 1995 (No. 1) ˙ Short title 1. This regulation may be cited as the Transport Infrastructure (Railways) Amendment Regulation (No. 1) 1995 . ˙ Regulation amended 2. This regulation amends the TransportInfrastructure(Railways)Regulation 1994 . ˙ Amendment of s 10 (Animals) 3.(1) Section 10(1)(a)— omit, insert— ‘(a) unless permitted under the Guide Dogs Act 1972 , bring an animal into a passenger compartment of a carriage; or’. (2) Section 10(1)(d)(iii)— omit . (3) Section 10— insert— ‘ (3) If an employee reasonably believes that to ensure safety at a level crossing at a particular time a person must not ride or drive an animal on the crossing, the employee may prohibit the person from riding or driving the animal on the crossing. ‘ (4) The person must obey the direction unless the person has a reasonable excuse. Maximum penalty—5 penalty units. ‘ (5) The rider or driver of an animal must not stay, or allow the animal to stay, on a level crossing for longer than is reasonably necessary for the animal to cross it. Maximum penalty—5 penalty units.’.
s4 3 s6 Transport Infrastructure (Railways) Amendment No. 66, 1995 (No. 1) ˙ Amendment of s 14 (Crossing of railway lines by pedestrians) 4. Section 14(2)— omit, insert— ‘ (2) A person must not enter a level crossing if— (a) a warning signal given by Queensland Railways is operating, sounding or has just sounded in the vicinity of the crossing; or (b) there is danger of a train striking the person. Maximum penalty—20 penalty units. ‘ (3) If an employee reasonably believes that to ensure safety at a level crossing at a particular time a person must not enter the crossing, the employee may direct the person not to enter the crossing. ‘ (4) The person must obey the direction unless the person has a reasonable excuse. Maximum penalty—20 penalty units. ‘ (5) A person must not stay on a level crossing for longer than is reasonably necessary for the person to cross it. Maximum penalty—20 penalty units.’. ˙ Omission of s 21 (Loitering) 5. Section 21— omit . ˙ Amendment of s 33 (Drivers to obey directions and warning signals) 6.(1) Section 33(a)— omit. (2) Section 33(b) and (c)— renumber as section 33(a) and (b). (3) Section 33—
s7 4 s7 Transport Infrastructure (Railways) Amendment No. 66, 1995 (No. 1) insert— ‘ (2) If an employee reasonably believes that to ensure safety at a level crossing at a particular time a person must not drive a vehicle on the crossing, the employee may direct the person not to drive the vehicle on the crossing. ‘ (3) The person must obey the direction unless the person has a reasonable excuse. Maximum penalty—5 penalty units. ‘ (4) The driver of a vehicle must not stay, or allow the vehicle to stay, on a level crossing for longer than is reasonably necessary for the vehicle to cross it. Maximum penalty—5 penalty units.’. ˙ Replacement of s 34 (Parking of vehicles) 7. Section 34— omit, insert— ˙ ‘ Parking of vehicles ‘ 34.(1) A vehicle’s driver must obey a direction by an employee or a direction indicated on a sign, about parking a vehicle on a railway, unless the driver has a reasonable excuse. Maximum penalty—5 penalty units. ‘ (2) A vehicle’s driver may only park the vehicle on a railway— (a) to engage in business with Queensland Railways; or (b) to bring a passenger to a railway to board a train; or (c) to pick up a person who is arriving, or has arrived, at a railway by train; or (d) for transporting the vehicle by rail. ‘ (3) A vehicle’s driver must comply with subsection (2) unless the driver has a reasonable excuse. Maximum penalty—5 penalty units.’.
