s1 2 s4 Transport Infrastructure (Rail) Amendment Regulation (No. 1) 2002 No. 364, 2002 1 Short title This regulation may be cited as the Transport Infrastructure (Rail) Amendment Regulation (No. 1) 2002 . 2 Regulation amended This regulation amends the TransportInfrastructure(Rail)Regulation 1996. 3 Amendment of s 10 (Injurious behaviour) (1) Section 10(3), after ‘railway’— insert — ‘or rolling stock’. (2) Section 10(4)(a), ‘, including, for example, the person’s feet (whether or not with shoes)’— omit . (3) Section 10(4)(b), after ‘railway’— insert — ‘or rolling stock’. 4 Amendment of s 13 (Railway crossings) (1) Section 13(1)— omit , insert — ‘ (1) A person, whether or not with an animal— (a) must not go on to a railway track other than for the purpose of crossing from one side to the other; and (b) must not cross a railway track other than by using a railway crossing.’. (2) Section 13(6), ‘or toy vehicle’— omit .

s5 3 s6 Transport Infrastructure (Rail) Amendment Regulation (No. 1) 2002 No. 364, 2002 (3) Section 13(8)— omit . 5 Replacement of pt 3 hdg Part 3, heading— omit , insert — ‘PART 3—PROPERTY ABANDONED OR LEFT ON RAILWAY OR ROLLING STOCK’. 6 Amendment of s 14 (Moving property abandoned or left on railways) (1) Section 14, heading— omit, insert— ‘14 Property abandoned or left on railways other than on rolling stock’. (2) Section 14(1), after ‘on a railway’— insert — ‘other than on rolling stock’. (3) Section 14(1)(b), ‘directions’— omit , insert— ‘direction’. (4) Section 14(3)— omit , insert— ‘ (3) In this section— “direction” , of a railway manager, includes the following— (a) a direction of an employee of a railway manager; (b) a direction of the railway manager indicated on a sign displayed on the railway, other than on rolling stock.’.

s7 4 s9 Transport Infrastructure (Rail) Amendment Regulation (No. 1) 2002 No. 364, 2002 7 Insertion of new s 14A After section 14— insert— ‘14A Property abandoned or left on rolling stock ‘ (1) This section applies if property— (a) is abandoned on rolling stock; or (b) is left on rolling stock against a railway operator’s direction. ‘ (2) The railway operator may take steps that are reasonable and necessary to move the property. ‘ (3) In this section— “direction” , of a railway operator, includes the following— (a) a direction of an employee of a railway operator; (b) a direction of the railway operator indicated on a sign displayed on rolling stock.’. 8 Amendment of s 15 (Notifying owner that property moved) Section 15(1) and (3), after ‘railway manager’— insert— ‘or railway operator’. 9 Amendment of s 16 (Moving expenses) (1) Section 16, after ‘railway manager’— insert— ‘or railway operator’. (2) Section 16(b), after ‘used on the railway’— insert— ‘or rolling stock’.
