This regulation may be cited as the Transport Infrastructure (Ports) Amendment Regulation (No. 1) 1994 . ˙ Regulation amended 2. This regulation amends the TransportInfrastructure(Ports)Regulation 1994 . ˙ Amendment of s 42 (Persons who are liable for damage to port authority’s works etc.) 3. Section 42(2)— omit, insert— ‘ (2) If damage is caused by floating or submerged material to a port authority’s works or infrastructure, the owner of the material is liable for the damage if it is intentionally, recklessly or negligently caused by the owner.’.
