s1 2 s3 Transport Infrastructure (Management of Harbour Works) Amendment (No. 1) No. 441, 1997 ˙ Short title 1. This regulation may be cited as the Transport Infrastructure (Management of Harbour Works) Amendment Regulation (No. 1) 1997 . ˙ Regulation amended 2. This regulation amends the Transport Infrastructure (Management of Harbour Works) Regulation 1992 . ˙ Amendment of s 2 (Management of harbour works) 3. Section 2(2) and (3)— omit, insert— ‘ (2) The management and control of harbour works includes— (a) the replacement of pile moorings, buoy moorings and dinghy racks; and (b) the maintenance of roads, parking areas, amenities and gardens; and (c) maintenance dredging, other than dredging of channels to public jetties, public pontoons and public boat ramps; and (d) all other aspects of managing and controlling the harbour works, including maintenance and funding of maintenance, unless otherwise agreed to by the chief executive. ‘ (3) The management and control of harbour works does not include replacement of— (a) public jetties; or (b) public pontoons; or (c) public boat ramps; or (d) breakwaters; or (e) navigational aids.’.

Section 3— omit, insert— ˙ ‘ Boat harbour mooring fees ‘ 3.(1) This section applies to a boat harbour mentioned in schedule 2. ‘ (2) The mooring fees stated in schedule 3 are payable for the boat harbour. ‘ (3) The mooring fees must be paid within 3 months of each due date. ‘ (4) In this section— “due date” means 30 June and 30 December in each year.’. ˙ Amendment of sch 1 (Harbour works) 5.(1) Schedule 1, ‘Council of the Shire of Albert’— omit, insert— ‘Council of the City of Gold Coast’. (2) Schedule 1, ‘Port of Brisbane Authority’— omit, insert— ‘Port of Brisbane Corporation’. (3) Schedule 1, ‘Harbours Corporation of Queensland’— omit, insert— ‘Ports Corporation of Queensland’. (4) Schedule 1, ‘Council of the Shire of Pioneer’— omit, insert— ‘Council of the City of Mackay’. (5) Schedule 1, ‘Council of the Shire of Mulgrave’— omit, insert— ‘Council of the City of Cairns’.
