An Act to amend the Transport Employees Retirement Benefits Act, 1967, as a consequence of the enactment of the Public Authorities Superannuation Act. 1985, [Assented to, 30th April, 1985.]
Transport Employees Retirement Benefits (Amendment) 1985
BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—
Short title.
1. This Act may be cited as the “Transport Employees Retirement
Benefits (Amendment) Act, 1985”.
Commencement.
2. (1) Sections 1 and 2 shall commence on the date of assent to this Act.
| (2) | Except as provided by subsection (1), this Act shall commence on the |
day appointed and notified under section 2 (2) of the Public Authorities
Superannuation Act, 1985.
Amendment of Act No. 96, 1967.
3. The Transport Employees Retirement Benefits Act, 1967, is amended
in the manner set forth in Schedule 1.

(Sec. 3.)
Amendments to the Transport Employees Retirement Benefits Act,
1967.
(1) (a) Section 3 (1), definition of “Board”—
Omit “constituted by the Public Authorities Superannuation Board Act, 1983”, insert instead “continued by the Public Authorities Superannuation Act, 1985” .
(b) Section 3 (1), paragraph (g) of the definition of “employee”—
After “Fund”, insert “ , or a person eligible to make an election under section 11 of the Public Authorities Superannuation Act, 1985”.

(c) Section 3 (1), definition of “Fund”—
Omit the definition, insert instead:—
“Fund” means the Public Authorities Superannuation Fund;
(2) Section 19—
Omit “fortnightly” wherever occurring, insert instead “monthly”.
(3) (a) Section 20 (1)—
Omit “a period of seven days from the date of deduction”, insert instead “7 days after the last day of the month to which the contributions relate” .
(b) Section 20 (3)—
Omit “seven days after deduction or the time the deduction, if not made, should have been made”, insert instead “7 days after the last day of the month to which the contributions relate” .
(4) Section 21 (1)—
Omit “A contributor shall cease to pay contributions to the Fund on the first day of the pay period”, insert instead “The last month in respect of which a contributor is required to make a contribution to the Fund is the month that immediately precedes the month” .
(5) Section 53 (2a)—
After section 53 (2), insert:—
(2a) Regulations may be made amending the Schedules, or substituting other Schedules, in order to provide for monthly contributions.
