The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Transport (Conduct) Regulations 2005 to—
(a)align several definitions with definitions in the Road Safety Road Rules 2009;
(b)clarify that people are permitted to ride bicycles on certain areas in rail premises.
2Authorising provision
These Regulations are made under section 56 of the Transport (Compliance and Miscellaneous) Act 1983.
3Commencement
These Regulations come into operation on 31 March 2014.
4Principal Regulations
In these Regulations, the Transport (Conduct) Regulations 2005[1] are called the Principal Regulations.
5Definitions
In regulation 3 of the Principal Regulations—
(a)for the definition of bicycle substitute—
"bicycle has the same meaning as in the Road Safety Road Rules 2009;";
(b)insert the following definition—
"Road Rules means the Road Safety Road Rules 2009;";
(c)for the definition of wheeled recreational device substitute—
"wheeled recreational device has the same meaning as in the Road Rules;";
(d)for the definition of wheeled toy substitute—
"wheeled toy has the same meaning as in the Road Rules.".
6Riding a bicycle etc.
At the end of regulation 35 of the Principal Regulations insert—
"(2) Subregulation (1) does not apply to a person riding a bicycle, wheeled recreational device or wheeled toy on rail premises or part of rail premises set aside for the use of vehicles.
Example
A bicycle path located on rail premises is an example of part of rail premises set aside for the use of vehicles.".
7Driving or riding a vehicle on rail premises
(1)In regulation 36(1) of the Principal Regulations omit "by the passenger transport company or the rail freight operator that is responsible for the premises or, if Rail Track is responsible for the premises, from Rail Track".
(2)At the foot of regulation 36(1) of the Principal Regulations insert—
"Example
A car park located on rail premises is an example of part of rail premises set aside for the use of vehicles.".
(3)In regulation 36(6) of the Principal Regulations the definition of Road Rules is revoked.
