PART 1—PRELIMINARY

1Objectives

The objectives of these Regulations are—

(a)to ensure that users of public transport services fairly contribute to the cost of services and behave safely and responsibly, by prescribing ticket and transport infringements including infringements for offences relating to—

(i)fare evasion; and

(ii)conduct; and

(iii)safe and fair use of public transport services and facilities; and

(iv)over-dimensional vehicles; and

(b)to align public transport penalties for children with the principles of fairness underlying the youth justice system by recognising that children should be treated differently from adults and prescribing different penalties for children; and

(c)to prescribe port safety infringements and infringement penalties in respect of those infringements; and

(d)to prescribe information to appear in infringement notices; and

(e)to prescribe the method of payment of penalties; and

(f)to prescribe other matters required, permitted or necessary to be prescribed by the Transport (Compliance and Miscellaneous) Act 1983.

2Authorising provisions

These Regulations are made under section 215 and section 230ZBB of the Transport (Compliance and Miscellaneous) Act 1983.

3Commencement

These Regulations come into operation on 1 December 2019.

4Revocations

The Regulations listed in Schedule 1 are revoked.

5Definitions

In these Regulations—

child in the case of a person who is alleged to have committed an infringement offence, means a person who at the time of the alleged commission of the infringement offence was of or above the age of 10 years and under the age of 18 years.

infringement notice means a ticket infringement notice, a transport infringement notice, or a port safety infringement notice.

the Act means the Transport (Compliance and Miscellaneous) Act 1983.

PART 2—INFRINGEMENTS

6Ticket infringements

(1)For the purposes of Part VII of the Act, a ticket offence set out in Column 2 of Schedule 2 is prescribed as a ticket infringement.

(2)If a person is alleged to have committed an offence against more than one of regulation 7(1), 8(2) or 10(3) of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017[1] in respect of the same travel in a passenger vehicle within the meaning of those Regulations, for the purposes of subregulation (1) only one of those offences may be the subject of a ticket infringement notice.

(3)If a person is alleged to have committed an offence against more than one of regulation 7(2), 9(2) or 11(3) of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017 in respect of the same entry to a compulsory ticket area within the meaning of those Regulations, for the purposes of subregulation (1) only one of those offences may be the subject of a ticket infringement notice.

(4)Subject to regulation 8, for the purposes of section 212(5) of the Act, the prescribed amount for a ticket infringement penalty is the amount of infringement penalty set out in Column 3 of Schedule 2 opposite the corresponding prescribed ticket offence set out in Column 2 of that Schedule.

7Transport infringements

(1)For the purposes of Part VII of the Act, an offence set out in Column 2 of a Table in Schedule 3 is prescribed as a transport infringement.

(2)Subject to regulation 8, for the purposes of section 212(5) of the Act, the prescribed amount for a transport infringement penalty is the amount of infringement penalty set out in Column 3 of a Table in Schedule 3 opposite the corresponding prescribed offence set out in Column 2 of that Table.

8Lower penalties for children

(1)This regulation applies if—

(a)a child is alleged to have committed a transport infringement or ticket infringement; and

(b)an infringement penalty is set out for that transport infringement or ticket infringement in Column 4 of Schedule 2 or a Table in Schedule 3.

(2)For the purposes of section 212(5) of the Act, the penalty prescribed is the corresponding infringement penalty set out in Column 4 of Schedule 2 or a Table in Schedule 3 despite any corresponding infringement penalty set out in Column 3.

9Port safety infringements

(1)For the purposes of Division 4A of Part VIIA of the Act, an offence set out in Column 2 of Schedule 4 is prescribed as a port safety infringement.

(2)For the purposes of section 230ZBA of the Act, the prescribed amount for a port safety infringement penalty is the amount of infringement penalty set out in Column 3 of Schedule 4 opposite the corresponding prescribed offence set out in Column 2 of that Schedule.

10Infringement notices

(1)In addition to the requirements of section 13 of the Infringements Act 2006, an infringement notice must state (as the case requires) whether it is an infringement notice in relation to—

(a)a ticket infringement; or

(b)a transport infringement; or

(c)a port safety infringement.

(2)If—

(a)an infringement notice contains a code by which the infringement offence may be identified; and

(b)a code exists by which the infringement offence may be identified for the purpose of regulation 8—

nothing in these Regulations prevents—

(c)the application of the infringement penalty in Column 3 of Schedule 2 or a Table in Schedule 3 (as the case requires) to that infringement offence if the offence is committed by a person who is not a child, whether or not the infringement offence is identified by the code for the infringement to which regulation 8 applies; or

(d)the application of the infringement penalty in Column 4 of Schedule 2 or a Table in Schedule 3 (as the case requires) to that infringement offence if the offence is committed by a child, whether or not the infringement offence is identified by the code for the infringement to which regulation 8 applies.

Note

The requirement for infringement notices prescribed in regulation 10(1) is in addition to those prescribed for the purpose of section 13 of the Infringements Act 2006 by the Infringements Regulations 2016[2]. The Infringements Regulations 2016 also prescribe the form of official warnings and form of withdrawal notice.

11Administrative costs payable in respect of certain ticket infringements

For the purposes of section 213A of the Act—

(a)administrative costs may be paid to passenger transport and bus companies in respect of relevant ticket infringements; and

(b)the administrative costs permitted to be paid to a passenger transport or bus company are $30 for each infringement notice issued for a relevant ticket infringement that relates to—

(i)a carriage operated by or on behalf of the company; or

(ii)land or premises owned, occupied or controlled by the company.

12Proof of prior convictions

(1)For the purposes of section 214(1) of the Act, the prescribed form is a document that sets out—

(a)the name and address of the person on whom the document is served; and

(b)in respect of each alleged prior conviction or finding of guilt—

(i)a statement of the court at which the person is alleged to have been convicted or found guilty; and

(ii)the date of the alleged conviction or finding; and

(iii)a short description of the alleged offence; and

(iv)a short description of the penalty imposed.

Note

Section 214(1) of the Act requires this form to be signed by the informant.

(2)For the purposes of section 214(2) of the Act, the prescribed form of notice is a document that states that if a person is served with a document setting out particulars of alleged prior convictions or findings of guilt, that document is admissible as evidence of those convictions and findings of guilt if—

(a)the person does not appear in answer to the summons for an infringement served with that document; and

(b)the person is convicted or found guilty of the infringement alleged in the summons.

The Transport (Compliance and Miscellaneous) (Infringements) Regulations 2019, S.R. No. 118/2019 were made on 26 November 2019 by the Governor in Council under sections 215 and 230ZBB of the Transport (Compliance and Miscellaneous) Act 1983, No. 9921/1983 and came into operation on 1 December 2019: regulation 3.

The Transport (Compliance and Miscellaneous) (Infringements) Regulations 2019 will sunset 10 years after the day of making on 26 November 2029 (see section 5 of the Subordinate Legislation Act 1994).

INTERPRETATION OF LEGISLATION ACT 1984 (ILA)

Style changes

Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.

References to ILA s. 39B

Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.

Interpretation

As from 1 January 2001, amendments to section 36 of the ILA have the following effects:

•     Headings

All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule.  Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.

•     Examples, diagrams or notes

All examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule.  Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule.  See section 36(3A).

•     Punctuation

All punctuation included in a Statutory Rule which is made on or after
1 January 2001 forms part of that Statutory Rule.  Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.

•     Provision numbers

All provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after
1 January 2001.  Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs.  See section 36(3C).

•     Location of "legislative items"

A "legislative item" is a penalty, an example or a note.  As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision.  For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision.  See section 36B.

•     Other material

Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule.  See section 36(3)(3D)(3E).

Penalty Units

These Regulations provide for penalties by reference to penalty units within the meaning of section 110 of the Sentencing Act 1991. The amount of the penalty is to be calculated, in accordance with section 7 of the Monetary Units Act 2004, by multiplying the number of penalty units applicable by the value of a penalty unit.

The value of a penalty unit for the financial year commencing 1 July 2024 is $197.59. The amount of the calculated penalty may be rounded to the nearest dollar.

The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
