Transport (Compliance and Miscellaneous) (Conduct on Public Transport) and (Ticketing) Further Amendment Regulations 2019

The Governor in Council makes the following Regulations:

Part 1—Preliminary

1Objective

The objective of these Regulations is to amend the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015 and the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017 as a consequence of the enactment of the Transport Legislation Amendment Act 2019.

2Authorising provisions

These Regulations are made under sections 56, 221AA, 230AH, 249B and 256 of the Transport (Compliance and Miscellaneous) Act 1983.

3Commencement

These Regulations come into operation on 1 January 2020.

Part 2—Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015

4Definitions

In regulation 5(1) of the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015[1]—

(a)in the definition of authorised person (conduct), in paragraph (e) omit "or the Public Transport Development Authority";

(b)in the definition of railway premises, in paragraph (d), for "Public Transport Development Authority" substitute "the Head, Transport for Victoria in connection with its functions in relation to passenger services".

Part 3—Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017

5Definitions and reference provisions

In regulation 5(1) of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017[2]—

(a)in the definition of authorised person (ticketing), in paragraph (e), for ", the Head, Transport for Victoria or the Public Transport Development Authority" substitute "or the Head, Transport for Victoria";

(b)in the definition of central computer system, for "Crown" substitute "Head, Transport for Victoria";

(c)in the definition of myki money, for "Crown" substitute "Head, Transport for Victoria";

(d)in the definition of retail agent omit "the Public Transport Development Authority, or".

6Ticket contracts

In regulation 17(1) of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017, for ", or the Head, Transport for Victoria on behalf of the Crown or the Public Transport Development Authority" substitute "or the Head, Transport for Victoria".

7Exemptions

In regulation 27 of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017—

(a)for paragraph (c)(ii) substitute

"(ii)the Secretary or the Head, Transport for Victoria; or";

(b)for paragraph (d) substitute

"(d)a person travelling in a passenger vehicle or in a compulsory ticket area if the passenger transport company, the bus company, the Secretary or the Head, Transport for Victoria has determined that a ticket is not required for that travel or that entry to the compulsory ticket area.

Examples for paragraph (d)

·   Free travel to a major event.

·   The Heritage City Circle Tram Service.".
