Transport (Compliance and Miscellaneous) (Conduct on Public Transport) and (Ticketing) Amendment (Prescribed Equipment and Processes) Regulations 2023

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1Objectives

The objectives of these Regulations are—

(a)to amend the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015 to prescribe an item of equipment for the purposes of section 222B(1) of the Transport (Compliance and Miscellaneous) Act 1983; and

(b)to amend the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017 to prescribe a device and processes for the purposes of Division 5 of Part VII of the Transport (Compliance and Miscellaneous) Act 1983.

2Authorising provisions

These Regulations are made under sections 56, 221AA, 230AH and 256 of the Transport (Compliance and Miscellaneous) Act 1983.

PART 2—AMENDMENT OF TRANSPORT (COMPLIANCE AND MISCELLANEOUS) (CONDUCT ON PUBLIC TRANSPORT) REGULATIONS 2015

3Prescribed equipment

After item 20 of Schedule 2 to the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015[1] insert—

"20A.A ZEBRA Model TC77.".

PART 3—AMENDMENT OF TRANSPORT (COMPLIANCE AND MISCELLANEOUS) (TICKETING) REGULATIONS 2017

4Definitions and reference provisions

In regulation 5(1) of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017[2], in the definition of Handheld V/line, after "a M3 Mobile M3 Orange" insert "or a ZEBRA Model TC77".

5Prescribed kinds of portable device

Before regulation 28(b) of the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017 insert—

"(ab)   the ZEBRA Model TC77;".

6Prescribed processes

After item 47 of Schedule 2 to the Transport (Compliance and Miscellaneous) (Ticketing) Regulations 2017 insert—

"47AThe process containing the steps set out in the following paragraphs—

(a)either or both of the following—

(i)copying or transferring, between a ZEBRA Model TC77 and a smartcard or a digital card, information relating to one or a combination of the following—

(A)the vehicle identification of a bus, train or tram;

(B)the route of that bus, train or tram;

(C)the location of that bus, train or tram;

(D)that smartcard or digital card;

(E)the use of that smartcard or digital card;

(F)entitlements to use a public transport service;

(ii)loading onto a ZEBRA Model TC77 information relating to one or a combination of the following—

(A)the vehicle identification of a bus, train or tram;

(B)the route of that bus, train or tram;

(C)the location of that bus, train or tram;

(D)smartcards or digital cards;

(E)the sale and use of smartcards or digital cards;

(F)entitlements to use a public transport service;

(b)storing information copied, transferred or loaded as described in paragraph (a) by a ZEBRA Model TC77;

(c)transferring or copying information stored as described in paragraph (b) by means of either or both a wired or wireless network to the central computer system;

(d)storing information transferred or copied as described in paragraph (c) by the central computer system;

(e)producing a printed record of information stored as described in paragraph (d).".
