Part 1 Transport and Other Legislation Amendment Regulation (No. 1) 2009 Part 1 Preliminary [s 1] Preliminary 1 Short title This regulation may be cited as the Transport and Other Legislation Amendment Regulation (No. 1) 2009 . 2 Commencement (1) Section 7 commences on 20 June 2009. (2) The remaining provisions commence on 1 July 2009. Part 2 Amendment of State Development and Public Works Organisation (State Development Areas) Regulation 1998 3 Regulation amended This part amends the StateDevelopmentandPublicWorksOrganisation (State Development Areas) Regulation 1998. 4 Amendment of s 5 (Functions of board) Section 5(1)(j), example 5, ‘The Central Queensland Ports Authority’— omit, insert— ‘Gladstone Ports Corporation Limited’. 2009 SL No. 93 Page 3
Transport and Other Legislation Amendment Regulation (No. 1) 2009 Part 3 Amendment of Transport Infrastructure (Ports) Regulation 2005 [s 5] Part 3 Amendment of Transport Infrastructure (Ports) Regulation 2005 5 Regulation amended This part amends the Transport Infrastructure (Ports) Regulation 2005. 6 Amendment of s 3A (Transfer of management of a port—Act, s 271(1)) (1) Section 3A, ‘to the’— omit, insert— ‘to’. (2) Section 3A— insert— ‘(2) The management of the port of Lucinda is transferred from Ports Corporation of Queensland Limited to Port of Townsville Limited on the transfer day. ‘(3) The management of the port of Mackay is transferred from Mackay Ports Limited to North Queensland Bulk Ports Corporation Limited on the transfer day. Note — Under the GovernmentOwnedCorporationsAmendmentRegulation(No. 1) 2008 , section 5, the name of Mackay Port Authority changed to Mackay Ports. Mackay Ports was subsequently incorporated under the Corporations Act 2001 (Cwlth) as Mackay Ports Limited. ‘(4) The management of the following ports is transferred from Ports Corporation of Queensland Limited to North Queensland Bulk Ports Corporation Limited on the transfer day— (a) port of Abbot Point; (b) port of Hay Point; Page 4 2009 SL No. 93
Transport and Other Legislation Amendment Regulation (No. 1) 2009 Part 3 Amendment of Transport Infrastructure (Ports) Regulation 2005 [s 7] (c) port of Maryborough; (d) port of Weipa. ‘(5) The management of the following ports is transferred from Ports Corporation of Queensland Limited to Cairns Ports Limited on the transfer day— (a) port of Burketown; (b) port of Cape Flattery; (c) port of Cooktown; (d) port of Karumba; (e) port of Mourilyan; (f) port of Port Kennedy; (g) port of Quintell Beach; (h) port of Skardon River. Note — Under the GovernmentOwnedCorporationsAmendmentRegulation(No. 1) 2008 , section 3, the name of Cairns Port Authority changed to Cairns Ports. Cairns Ports was subsequently incorporated under the Corporations Act 2001 (Cwlth) as Cairns Ports Limited.’. 7 Insertion of new s 4AA After section 4— insert— ‘4AA Declaration of an entity as a port authority—Act, s 274A(a) ‘North Queensland Bulk Ports Corporation Limited is declared a port authority on the commencement of this section.’. 8 Amendment of s 4A (Revocation of declaration of a body as a port authority—Act, s 274A(c)) (1) Section 4A, heading ‘a body’— omit, insert— 2009 SL No. 93 Page 5
