s1 3 s4 Transport and Other Legislation Amendment Regulation (No. 1) 2003 No. 180, 2003 PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Transport and Other Legislation Amendment Regulation (No. 1) 2003 . 2 Commencement This regulation commences on 1 September 2003. s5 4 s8 Transport and Other Legislation Amendment Regulation (No. 1) 2003 No. 180, 2003 PART 3—AMENDMENT OF TRANSPORT OPERATIONS (ROAD USE MANAGEMENT) REGULATION 1995 5 Regulation amended in pt 3 This part amends the TransportOperations(RoadUseManagement)Regulation 1995. 6 Amendment of s 33D (Refusing application) Section 33D(2)— omit, insert (2) Subsection (1) does not limit the grounds on which the chief executive may refuse the application. 1 ’. 7 Amendment of s 33DA (Statutory conditions on appointment) Section 33DA, ‘approved examiner’— omit, insert ‘accredited person’. 8 Replacement of s 33F (Display of accreditation document or identity card) Section 33F— omit, insert ‘33F Display of accreditation document or identity card (1) An accredited person must, while performing the function of an accredited person, display the person’s accreditation document or identity card so it is clearly visible. 1 See s 21(1) (Appointment of accredited persons) of the Act and sections 33N, 33P and 33T of this regulation.

Displaying the document on premises or in a vehicle being used by the person. 2. Wearing the card on the person’s clothing. Maximum penalty—20 penalty units. (2) However, if it is not practicable to display the accreditation document or identity card, including, for example, because of its size or because it can not be attached to the person’s clothing, the person must— (a) carry the document or card while performing the person’s function; and (b) produce it for inspection if asked by a police officer or another authorised officer. Maximum penalty—20 penalty units.’. 9 Insertion of new s 33KA After section 33K— insert ‘33KA Only accredited person to be employed or engaged as traffic controller ‘A person must not employ, or otherwise engage, an individual to carry out the function of a traffic controller unless the individual is a traffic controller. Maximum penalty—20 penalty units.’. 10 Insertion of new pt 4A, div 5 After section 33R— insert ‘Division 5—Traffic controllers ‘33S Function ‘The function of an accredited person who is a traffic controller is to direct traffic in a way stated in the MUTCD, the TCASAP and schedule 1B.
s 11 6 s 11 Transport and Other Legislation Amendment Regulation (No. 1) 2003 No. 180, 2003 ‘33T Necessary expertise for appointment (1) For section 21 of the Act, a person has the necessary expertise to be appointed as a traffic controller if the person— (a) has successfully completed an approved training course; and (b) has, within the last 5 years, held a qualifying driver licence for a continuous period of at least 1 year. (2) In this section— “approved training course” means— (a) a training course for traffic controllers approved by the chief executive of the department that administers the TransportInfrastructure Act 1994 to the extent it relates to roads; or (b) another course the chief executive of that department is satisfied is at least the equivalent of a course mentioned in paragraph (a). “qualifying driver licence” means an Australian driver licence other than a learner licence or a licence equivalent to a learner licence.’. 11 Insertion of new pt 6, div 2AA Part 6, after section 62B— insert ‘Division 2AA—Traffic controllers ‘62BA Traffic controller to comply with condition of appointment ‘A traffic controller must not contravene a condition of the traffic controller’s appointment. Maximum penalty—20 penalty units. ‘62BB Offence to carry out traffic controller’s function ‘A person who is not a traffic controller must not carry out the function of a traffic controller. Maximum penalty—20 penalty units.’.

(2) The person is a traffic controller by the operation of this section until the earliest of the following days— (a) if the person applies under part 4A for appointment as a traffic controller—the day the chief executive grants, or refuses to grant, the application; (b) the day the person’s current authority expires; (c) the day the person surrenders the person’s current authority to the chief executive; (d) the day that is 1 year after the commencement.
s 15 8 s 16 Transport and Other Legislation Amendment Regulation (No. 1) 2003 No. 180, 2003 (3) The person holds office as a traffic controller by the operation of this section on the conditions, if any, stated in the person’s current authority. (4) In this section— “commencement” means the commencement of this section. “current authority” means a certificate— (a) issued by an entity that was, when the certificate was issued, accredited by the chief executive of the department that administers the Transport Infrastructure Act 1994 to the extent it relates to roads to provide training for persons who, before the commencement, carried out the function that is the function of a traffic controller under this regulation; and (b) that has not expired or been cancelled or surrendered; stating that a person has received the training mentioned in paragraph (a).’. 15 Amendment of sch 1 (Fees) Schedule 1, part 2, item 1— insert ‘(c) traffic controller. . . . . . . . . . . . . . . . . . . . . 70.50’. 16 Insertion of new sch 1B After schedule 1A— insert
