An Act to amend section 132a of the Transport Act, 1930, to increase the amounts of gratuities to which certain officers referred to in that section or their dependants are entitled. [Assented to, 17th December, 1976.]

Transport {Amendment).

O E it enacted by the Queen’s Most Excellent Majesty, by

and with the advice and consent of the Legislative

Council and Legislative Assembly of New South Wales in

Parliament assembled, and by the authority of the same, as

follows: —

1.     This Act may be cited as the “Transport (Amendment) short title

Act, 1976”.

2. The Transport Act, 1930, is amended—

(a)

“gratuity equivalent to the amount of two weeks’ p^yfbTfo

by omitting from section 132a (3) the words and by inserting instead the words “gratuity butOTs.) determined in accordance with subsection (4 a ) ” ;

(b)

by omitting from section 132a (4) the words “gratuity equivalent to the amount of two weeks’ salary or wages for each complete year of service” and by inserting instead the words “gratuity deter­ mined in accordance with subsection (4 a ) ” ;

(c)

by inserting after section 132a (4) the following subsection :—

(4a ) The gratuity payable under subsection (3) to an officer, or under subsection (4) in respect of an officer, shall be equivalent to the amount of—

(a)

where he had not less than 10 but less than 20 years’ service—2 weeks’ salary or wages;

(b)

where he had not less than 20 but less than 30 years’ service—2.35 weeks’ salary or wages;

(c)

Act No. 100, 1976.

(c)

where he had not less than 30 but less than 40 years’ service—2.75 weeks’ salary or wages; or

(d)

where he had not less than 40 years’ service— 3 weeks’ salary or wages,

for each complete year of service.

Application

Section 132a of the Transport Act, 1930, as amended

mente^oor by this Act, in addition to its application to and in respect of

in respect of an officer who is retired or dies after the commencement of

oflS^ this Act, applies to and in respect of an officer who was retired or died before that commencement but not before 1st April, 1976, as if it had been in force at the time of his retirement or death.
