Transport Administration (Staff) Amendment

Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Transport Administration Act 1988.

Explanatory note
The object of this Regulation is to amend the Transport Administration (Staff) Regulation 2012 as a consequence of the repeal of the Public Sector Employment and Management Act 2002 by the Government Sector Employment Act 2013 and the transfer, by administrative arrangements order under Part 7 of the Constitution Act 1902, of staff employed in the RMS and STA Divisions of the Government Service to the Transport Service.

This Regulation is made under the Transport Administration Act 1988, including sections 68E and 119 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Transport Administration (Staff) Amendment Regulation
2014.

2      Commencement

This Regulation commences on 24 February 2014 and is required to be published on the NSW legislation website.

[1]      Clause 3 Definitions

Omit the definition of Chief Executive. Insert instead in alphabetical order:

Transport Secretary means the Secretary of the Department of Transport.

[2]      Clause 3, definitions of “RMS officer” and “STA”

Omit the definitions.

[3]      Clause 3, definition of “STA employee”

Omit the definition. Insert instead:

STA employee means a member of the Transport Service designated as an
STA employee by the Transport Secretary.

[4]      Part 2, heading

Omit “staff”. Insert instead “employees”.

[5]      Clauses 4–8 and 11

Omit “Chief Executive” and “Chief Executive’s” wherever occurring.
Insert instead “Transport Secretary” and “Transport Secretary’s”, respectively.

[6]      Clauses 4 (2), 5 (1), 6 (5) and 8 (1) and (5)

Omit “service of the STA” wherever occurring. Insert instead “Transport Service”.

[7]      Clause 4 (5) (a)

Insert “officer’s” after “STA”.

Omit “that service” wherever occurring in clause 5 (1).
Insert instead “the Transport Service”.

Omit the clauses.

Omit the Divisions.

Omit the Part.

[12]      Clause 28 Definitions

Insert after paragraph (e) of the definition of disciplinary action:

(f) a fine of an amount not exceeding $100.

Omit “Director-General” wherever occurring. Insert instead “Transport Secretary”.

[14]      Clause 32A

Insert in Part 6 before clause 32:

32A Groups of staff within Transport Service

The Transport Secretary may create groups (however described) of staff of the Transport Service and designate members of the Transport Service to any such group.
