HIS Excellency the Governor, with the advice of the Executive

Council, and in pursuance of the Transport Administration Act 1988, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Transport Administration

(Dangerous Goods - SRA) Regulation 1989.

Commencement

2. This Regulation takes effect on 2 February 1990.

Definitions

3. In this Regulation:

"Authority" means the State Rail Authority
"Code" means the Australian Code for the Transport of Dangerous

Goods by Road and Rail, as published in the Commonwealth of Australia Gazette No. P15 of 7 April 1987, and includes the General Conditions for the Rail Transport of Dangerous Goods which accompany that Code.

Adoption of Code

4. The provisions of the Code have effect in relation to the transport

by the Authority of dangerous goods by rail.

Offence - contravention of Code

5. A person who contravenes or fails to comply with any requirement imposed by the Code on the person is guilty of an offence against this Regulation.

Maximum penalty 5 penalty units.
