1. Objectives

d

n The objectives of these Regulations are—
a (a) to prescribe certain injuries to be a severe
n injury under section 60(2B) of the
o
ti Transport Accident Act 1986;
la (b) to revoke regulation 13 of the Transport
is Accident Regulations 1996.

L These Regulations are made under section 132 of
n the Transport Accident Act 1986.

3. Severe injury

After regulation 5 of the Transport Accident

ts Regulations 19961 insert—
n '5A. Severe Injury
e
(1) For the purposes of section 60(2B) of the
m
u Act, the following injuries are a severe
c injury—
o (a) permanent blindness;

(b) burns to not more than 50 percent of the
ry body that cause severe disfigurement
ta and comprise of full thickness burns—
n (i) to the head, neck, arms or lower
e legs; or
m
ia (ii) that result in severe difficulties in
rl performing mobility,
a communication and self care
P tasks;
d (c) a brachial plexus injury that results in
n the loss of the use of a limb.
a (2) In this regulation "permanent blindness"
n means—
o
ti (a) a field of vision that is constricted to
la 10 degrees or less of arc from central
is fixation in the better eye irrespective of
g corrected visual acuity; or
e (b) a corrected visual acuity of less than
L 6/60 of the Snellen Scale in both eyes;
n or
a
ri (c) a combination of visual defects
to resulting in the same degree of visual
loss as referred to in paragraph (a)
ic or (b).'.
