Transport Accident Amendment (Home Modification Agreement) Regulations 2018

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Transport Accident Regulations 2017 to prescribe the threshold amount that the Transport Accident Commission must not exceed for a payment or contribution to a person under section 60(4) of the Transport Accident Act 1986 unless the person enters into an agreement with the Commission in relation to the ownership of, and maintenance of modifications to, a home or semi-detachable portable unit.

2Authorising provision

These Regulations are made under section 132 of the Transport Accident Act 1986.

3Limit for home modification payments

For regulation 11 of the Transport Accident Regulations 2017[1] substitute—

"11   Prescribed limit for home modification payment by the Commission

The prescribed greater amount under section 60(5) of the Act for the purposes of section 60(4) of the Act is $50 000.".
