1Objective

The objective of these Regulations is to prescribe the periods and times or intervals for the payment of transport accident charges in relation to motor vehicles of specified classes.

2Authorising provision

These Regulations are made under section 132 of the Transport Accident Act1986.

3Commencement

These Regulations come into operation on


23 May 2021.

4Revocation

The Transport Accident (Administration of Charges) Regulations 2011[1] are revoked.

5Prescribed periods

For the purposes of section 109 of the Transport Accident Act 1986, the following periods are prescribed in relation to motor vehicles of the classes specified—

4 Motor vehicles in possession of, or under the control of, a person to whom a general identification mark has been assigned under regulation 155 of the Road Safety (Vehicles) Regulations 2021 12 months
5 Motor vehicles in respect of which a club permit has been issued under regulation 177 of the Road Safety (Vehicles) Regulations 2021 12 months
6 Motor vehicles in respect of which an unregistered vehicle permit has been granted under Division 2 of Part 3 of the Road Safety (Vehicles) Regulations 2021 Period of validity of permit

Motor vehicles—

(a)   that are not registered in accordance with the Road Safety Act 1986 because they are exempt from registration in accordance with Part 2 of that Act or the Road Safety (Vehicles) Regulations 2021 as visiting overseas motor vehicles; and

Period commencing on arrival in Victoria and ending on the date the motor vehicle ceases to be entitled to be insured in Victoria
(b)   whose owners and drivers are not insured under a contract of insurance in accordance with the law of another State or Territory against liability in respect of death or injury to any person caused by or arising out of the use of the motor vehicles in Victoria
8 Motor vehicles that are not registered under the Road Safety Act1986 and are not otherwise referred to in this table 12 months

6Prescribed times and intervals

For the purposes of section 109 of the Transport Accident Act 1986, the following times or intervals are prescribed in relation to motor vehicles of the classes specified—

Motor vehicles—

(a)   that are not registered in accordance with the Road Safety Act 1986 because they are exempt from registration in accordance with Part 2 of that Act or the Road Safety (Vehicles) Regulations 2021 as visiting overseas motor vehicles; and

(b)   whose owners and drivers are not insured under a contract of insurance in accordance with the law of another State or Territory against liability in respect of death or injury to any person caused by or arising out of the use of the motor vehicles in Victoria

On or before arrival in Victoria
8 Motor vehicles that are not registered under the Road Safety Act1986 and are not otherwise referred to in this table On the date the application for the transport accident charge is made and on each anniversary of that date

7Refund of transport accident charge

(1)If the registration of a motor vehicle is cancelled and a transport accident charge is no longer required to be paid in respect of that motor vehicle, the amount of the refund payable to the owner of the motor vehicle for the prescribed period related to that registration is the amount calculated, in accordance with the formula—

where—

Ais the amount of the transport accident charge paid, including duty payable under the Duties Act 2000 in respect of the prescribed period;

Bis the number of days remaining in the relevant prescribed period at the time of the cancellation of the registration;

Cis the number of days in the prescribed period.

(2)Subregulation (1) applies to a motor vehicle that is not registered under the Road Safety Act 1986 and in respect of which a transport accident charge has been paid for the prescribed period if the motor vehicle is disposed of or destroyed as though—

(a)a reference to the cancellation of registration is a reference to the disposal or destruction of the motor vehicle; and

(b)a reference to the registration of the vehicle is a reference to the ownership of the vehicle.

The Transport Accident (Administration of Charges) Regulations 2021, S.R. No. 46/2021 were made on 18 May 2021 by the Governor in Council under section 132 of the Transport Accident Act 1986, No. 111/1986 and came into operation on 23 May 2021: regulation 3.

The Transport Accident (Administration of Charges) Regulations 2021 will sunset 10 years after the day of making on 18 May 2031 (see section 5 of the Subordinate Legislation Act 1994).

INTERPRETATION OF LEGISLATION ACT 1984 (ILA)

Style changes

Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.

References to ILA s. 39B

Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.

Interpretation

As from 1 January 2001, amendments to section 36 of the ILA have the following effects:

•     Headings

All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule.  Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.

•     Examples, diagrams or notes

All examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule.  Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule.  See section 36(3A).

•     Punctuation

All punctuation included in a Statutory Rule which is made on or after
1 January 2001 forms part of that Statutory Rule.  Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.

•     Provision numbers

All provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after
1 January 2001.  Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs.  See section 36(3C).

•     Location of "legislative items"

A "legislative item" is a penalty, an example or a note.  As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision.  For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision.  See section 36B.

•     Other material

Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule.  See section 36(3)(3D)(3E).
