Transplantation and Anatomy Act AmendmentAct (No. 2) 1984 No. 90 965 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Transplantation and Anatomy Act Amendment Act 1984 (No. 2). (2) In this Act the Transplantation and Anatomy Act 1979 as amended by the Transplantation and Anatomy Act Amendment Act1984 is referred to as the Principal Act. (3) The Principal act as amended by this act may be cited as the Transplantation and Anatomy Act 1979-1984. 2. New s. 48A. The Principal act is amended by inserting after section 48 the following section:- "48A. Offence to give false or misleading information. (1) A person shall not, in connexion with a proposal to remove tissue from any body for the purpose of transplantation or transfusion or for use for other therapeutic, medical or scientific purposes, knowingly furnish information that is false or mis- leading concerning the suitability of the body for removal of the tissue for the purpose in question. Penalty: $10 000 or imprisonment for two years or both. (2) It is immaterial for the purposes of subsection (1) whether the body from which tissue is to be removed is that of a living person or a deceased person.". 3. Amendment of s. 49. Disclosure of information . Section 49 of the Principal Act is amended by, in subsection (3)- (a) re-designating provision (d) as provision (e); (b) inserting after provision (c) the following provision:- "(d) for the purpose of investigating whether an offence defined in section 48A has been committed;".
