Transfer Rules Variation Determination No. 1 of 2005

Financial Sector (Transfers of Business) Act 1999

I, John Francis Laker, Chair of the Australian Prudential Regulation Authority, under subsection 46(1) of the Financial Sector (Transfers of Business) Act 1999 (‘the Act’) and subsection 33(3) of the Acts Interpretation Act 1901 VARY the Transfer Rules No. 1 of 2004 as set out in the Schedule. 

The variation shall come into effect upon registration of this Determination on the Federal Register of Legislative Instruments.

Schedule

In subparagraph 8(c)(i) of the Transfer Rules No. 1 of 2004:

OMIT: ‘the financial position of the transferring body and the receiving body (including a copy of the latest audited financial statements for each body); and’

and

SUBSTITUTE: ‘the financial position of the transferring body and the receiving body; and’
