Transfer of Land (Fees) (Amendment) Regulations

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are to revoke and replace certain fees and amounts payable under the Transfer of Land Act 1958.

2. Authorising provisions

These Regulations are made under section 120 of the Transfer of Land Act 1958.

3. Commencement

These Regulations come into operation on
1 January 1999.

4.  Revocation and replacement of certain fees and payments

In regulation 7 of the Transfer of Land (Fees)
Regulations 19931—

Transfer of Land (Fees) (Amendment) Regulations 1998

r. 4 S.R. No. 164/1998

(a)	for the items relating to section 10(4), section 12 and section 26M of the Transfer of Land Act 1958 substitute—
"26R Caveat against creation of folio or removal of warning or withdrawal of such a caveat. $15.00".
(b)	in the item relating to section 74 of the Transfer of Land Act 1958, omit "(except a mortgage or charge lodged immediately after an application under section 26D of the Act)";

(c) item 8 of the miscellaneous fees is revoked.
