Trans-Tasman Mutual Recognition (Tasmania) Temporary Exemptions Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 6 of the Trans-Tasman Mutual Recognition (Tasmania) Act 2003 .23 July 2007

1Short titleThese regulations may be cited as the Trans-Tasman Mutual Recognition (Tasmania) Temporary Exemptions Regulations 2007 . 2CommencementThese regulations take effect on 1 August 2007. 3InterpretationIn these regulations, unless the contrary intention appears – State Act means the Trans-Tasman Mutual Recognition (Tasmania) Act 2003 ; tobacco product means tobacco product as defined in the Public Health Act 1997 . 4Temporary exemptions for tobacco productsFor the purposes of section 46 of the Commonwealth Act as adopted by the State Act – (a) goods that are tobacco products are declared to be exempt from the operation of the Commonwealth Act; and (b) the Public Health Act 1997 , to the extent that it deals with tobacco products, is declared to be a law that is exempt from the operation of the Commonwealth Act. 5ExpiryThese regulations expire on 31 July 2008.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) declare goods that are tobacco products and the Public Health Act 1997 , to the extent that it deals with tobacco products, to be exempt from the operation of the Trans-Tasman Mutual Recognition Act 1997 of the Commonwealth; and (b) expire on 31 July 2008.
