His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Trans-Tasman Mutual Recognition (New South Wales) Act 1996.

Explanatory note
The object of this Regulation is to declare certain provisions of the Electricity Safety (Equipment Efficiency) Regulation 1999 to be exempt from the operation of the 1996 Trans-Tasman Mutual Recognition Arrangement. The provisions to be exempted deal with energy efficiency performance criteria or energy efficiency requirements for electrical articles. The exemption provided by this regulation is temporary (ie it will operate for no longer than 12 months) and only has effect if the laws being exempted are substantially for the purpose of protecting the health and safety of persons in New South Wales, or preventing, minimising or regulating environmental pollution in New South Wales.
This Regulation is made under section 5 of the Trans-Tasman Mutual
Recognition (New South Wales) Act 1996.
This Regulation relates to matters arising under legislation that is substantially
uniform or complementary with legislation of the Commonwealth and other

States.

3 Amendment of Trans-Tasman Mutual Recognition (New South

Wales) Temporary Exemptions Regulation 1998

The Trans-Tasman Mutual Recognition (New South Wales) Temporary Exemptions Regulation 1998 is amended as set out in Schedule 1.

Amendment of Trans-Tasman Mutual Recognition (New South

Wales) Temporary Exemptions Regulation 1998

Insert after clause 5:

6 Further temporary exemption relating to standards for

electrical articles

(1)

In accordance with section 5 of the State Act, the Electricity Safety (Equipment Efficiency) Regulation 1999 is, for the purposes of section 46 of the Commonwealth Act, declared to be exempt from the operation of the Commonwealth Act to the extent that it provides for standards relating to energy efficiency performance criteria or energy efficiency requirements with which electrical articles must comply.

(2) In accordance with section 46 (4) of the Commonwealth Act,
subclause (1) ceases to have effect on 4 November 2000.
