Training Guarantee (Wool Industry) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Training Guarantee (Administration) Act 1990.

1.   Commencement

1.1   These Regulations are taken to have commenced on 1 July 1991.

2.   Amendment

2.1   The Training Guarantee (Wool Industry) Regulations are amended as set out in these Regulations.

3. Regulation 4 (Wool

industry training rate)

3.1

 Omit the definition of “Employer factor”, substitute:

“Employer factor” is the AWC estimate of the total training expenditure for the year by an employer:

  • (a)

    on salary or wages paid to employees undertaking courses for wool industry workers run by the AWC or by a technical and further education institution; and

  • (b)

    on fees paid to a technical and further education institution for courses for wool industry workers; and

  • (c)

    on other payments made to or on behalf of employees which are directly attributable to their attendance at a course for wool industry workers run by the AWC or by a technical and further education institution;”.

4. Regulation

6 (Delegation by Minister)

4.1   Regulation 6:

Omit the regulation, substitute:

Delegation of Minister’s powers

“6.

(1) The Minister may, in writing, delegate his or her powers:

  • (a)

    to make and revoke scheme decisions; and

  • (b)

    to make any decision, exercise any power and perform any function which is ancillary to the power to make and revoke scheme decisions and in particular, but without limiting the generality of this paragraph, do anything required or empowered under subregulations 7 (3), 8 (3) and 15 (2), and regulations 9, 13 and 14.

“(2)

The powers may be delegated only to the person holding or performing the duties of one of the following Senior Executive Service offices in the Department:

  • (a)

    First Assistant Secretary, Vocational Education and Training Division;

  • (b)

    Principal Adviser, Vocational Education and Training Division;

  • (c)

    Assistant Secretary, Training Guarantee Unit.”.
