Training Guarantee (Administration) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Training Guarantee (Administration) Act 1990.

1.   Commencement

1.1   These Regulations are taken to have commenced on 1 July 1990.

2.   Amendment

2.1   The Training Guarantee (Administration) Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   Insert the following definition:

“‘Commonwealth funded employment program’ has the same meaning as in section 23 of the Social Security Act 1991;”.

4.   New regulation 2c

4.1   After regulation 2b, insert:

Persons paid under a Commonwealth funded employment program to be prescribed persons

 “2c. For the purposes of paragraph (e) of the definition of “employee” in section 4 of the Act, a person who is receiving income that is paid by a community or group from funds provided under a Commonwealth funded employment program is a prescribed person.”.
