Editorial changes
The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.
This republication does not include amendments made under part 11.3 (see endnote 1).

Penalties
At the republication date, the value of a penalty unit for an offence against this law is $150 for an individual and $750 for a corporation (see Legislation Act 2001, s 133).

Delegation by council to director, CIT—Act, s 10 (d)
(1)The council may delegate the exercise of its function under the Act, section 8 (1) (b) to the director, CIT.
NoteThe function mentioned in the Act, s 8 (1) (b) is accreditation of vocational education and training courses and higher education courses.
(2)In this section:
director, CIT means the director under the Canberra Institute of Technology Act 1987.
4ADelegation by council to TVET Australia Limited—Act, s 10 (d)
The council may delegate the exercise of its functions under the Act to—
(a)Technical and Vocational Education and Training Australia Limited (ACN 062 758 632) (TVET Australia); or
(b)an officer or employee of TVET Australia.
Cancelling accreditation of higher education course—
Act, s 76 (2)
The council may cancel the accreditation of a higher education course if—
(a)the course does not meet the higher education standards; or
(b)the council is satisfied that the person providing the course does not have the educational or management capacity to provide the course.

Legislation history
This regulation was originally the Tertiary Accreditation and Registration Regulations 2004. It was renamed under the Legislation Act 2001 and by the Training and Tertiary Education Legislation Amendment Act 2007 A2007-12 (see amdt 1.19).
