Traffic (General and Local) Amendment Regulations 1999
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .15 June 1999

1Short titleThese regulations may be cited as the Traffic (General and Local) Amendment Regulations 1999 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Traffic (General and Local) Regulations 1956 are referred to as the Principal Regulations. 4Regulation 2 amended (Interpretation)Regulation 2(1) of the Principal Regulations is amended as follows: (a) by inserting after the definition of "heavy vehicle" the following definitions: laser detection device means a device that may be used to detect or interfere with a laser speed analyser; laser speed analyser means a device which, by means of a laser – (a) measures the speed of a motor vehicle; and (b) displays the measured speed numerically on a dial of that device; (b) by inserting after the definition of "traffic control light signal" the following definition: train includes any vehicle constructed or adapted for propulsion on railway tracks; 5Regulation 5 amended (General rules)Regulation 5(1) of the Principal Regulations is amended as follows: (a) by omitting "engine, trolley, carriage, or wagon" from paragraph (ja) and substituting "train"; (b) by omitting paragraph (jb) and substituting the following paragraph: (jb) the person must not drive or attempt to drive a vehicle or lead or attempt to lead an animal across a railway level crossing or other place on a railway if a train approaching the crossing or other place can be seen or heard from the crossing or other place and there would be a danger of a collision with the train if the driver continued; (c) by omitting paragraph (jd). 6Regulation 7B amended (Seizure of radar detection devices and laser detection devices)Regulation 7B of the Principal Regulations is amended by inserting "or laser detection device" after "radar detection device", wherever occurring. 7Regulation 8 amended (Offences)Regulation 8(1) of the Principal Regulations is amended by omitting paragraph (e) and substituting the following paragraph: (e) drive or cause or permit to be driven a vehicle that has in or on it a device, whether or not the device is operating or in working order, for – (i) preventing the effective use of a speed measuring device within the meaning of the Traffic (Miscellaneous) Regulations 1968 ; or (ii) detecting the use of a speed measuring device within the meaning of those regulations. 8Regulation 25 amended (Road signs) (1) The table set out in regulation 25(3) of the Principal Regulations is amended as follows: (a) by omitting from that table the entries relating to road sign No. 4 and road sign No. 5; (b) by omitting from paragraph (b) of the entry in the second column of that table relating to road sign No. 9 "section." and substituting "section; or"; (c) by inserting after paragraph (b) of the entry in the second column of that table relating to road sign No. 9 the following paragraph: (c) in the case of a railway level crossing, give way to any train that is on, entering or approaching the crossing and there would be a danger of a collision with the train if the driver entered the crossing. (d) by omitting from paragraph (b) of the entry in the second column of that table relating to road sign No. 10 "sign." and substituting "sign; or"; (e) by inserting after paragraph (b) of the entry in the second column of that table relating to road sign No. 10 the following paragraph: (c) in the case of a railway level crossing – (i) stop at the stop line adjacent to the sign or, if there is no stop line, at the stop sign and before entering the crossing; and (ii) not enter the crossing if there is a train on, entering or approaching the crossing and there would be a danger of a collision with the train if the driver entered the crossing; and (iii) not proceed until the train has passed. (f) by inserting in that table after the entry relating to road sign 15 the following entries: | No. 15A - Area speed limit | Notwithstanding road sign No. 15, a driver, on reaching or passing this sign, must not drive a vehicle on the public street on which it is placed or the network of public streets past which it is placed, at a speed exceeding the number of kilometres per hour indicated by numerals on the sign, until reaching road sign No. 15B. |

(2) Regulation 25 is further amended by inserting after subregulation (13) the following subregulation: (14) It is not necessary in proceedings for the contravention of subregulation (3) in relation to road sign No. 15A to prove the reaching or passing of that sign. 9Regulation 26 amended (Prohibiting or restricting signs)Regulation 26 of the Principal Regulations is amended as follows: (a) by omitting subregulation (10) and substituting the following subregulation: (10) The prohibitions and restrictions specified in the second column of the table set out at the end of subregulation (5) in respect of road sign No. 30 do not apply to a vehicle belonging to the holder of an exemption permit issued under regulation 27 while the permit is displayed on the windscreen of the vehicle. (b) by omitting from subregulation (10B) "sign No. 30A" and substituting "signs Nos. 28A, 30 and 30A". 10Regulation 28 amended (Markings on road)Regulation 28 of the Principal Regulations is amended by omitting subregulation (8A). 11Regulation 29A rescindedRegulation 29A of the Principal Regulations is rescinded. 12Schedule 4 amended (Signs)Schedule 4 to the Principal Regulations is amended as follows: (a) by omitting road sign No. 4 and road sign No. 5 from Part I; (b) by inserting after road sign No. 15 in Part I, the following road signs:Road sign No 15A

EXPLANATORY NOTE
(This note is not part of the regulation) These regulations amend the
(a) providing for stop signs and give way signs at railway level crossings; and (b) introducing area speed limits; and (c) prohibiting the use of devices that can detect laser speed analysers; and (d) making miscellaneous amendments.
