Traffic (Compliance and Enforcement) Amendment Regulations 2008
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .11 August 2008

1Short titleThese regulations may be cited as the Traffic (Compliance and Enforcement) Amendment Regulations 2008 . 2CommencementThese regulations take effect on 25 August 2008. 3Principal RegulationsIn these regulations, the Traffic (Compliance and Enforcement) Regulations 2001 are referred to as the Principal Regulations. 4Regulation 5A insertedAfter regulation 5 of the Principal Regulations , the following regulation is inserted: 5APrescribed offences for section 43H of the Act For the purposes of section 43H(6A) of the Act, the following are prescribed offences: (a) a parking offence; (b) a speeding offence; (c) an offence under regulation 8(6) or (7) of the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 . 5Schedule 2 amended (Traffic infringement notice offences ) Part 2 of Schedule 2 to the Principal Regulations is amended as follows: (a) by omitting item 142 and substituting the following: | 142. | Novice driver or novice rider in P1 stage fail to display clearly visible P-plates as required | DLVR 9(6) | 50 | 2 | L060 |

(e) by omitting "motor cycle licence issued before 1 July 2007 (other than learner licence)" from column 2 of item 153A in the table and substituting "P1 provisional licence issued before 1 July 2007 in relation to a motor cycle"; (f) by omitting "motor cycle licence (other than learner licence)" from column 2 of item 153B in the table and substituting "P1 provisional licence in relation to a motor cycle"; (g) by omitting "unless holder permitted by regulation 10(2) of the DLVR" from column 2 of item 153B in the table ; (h) by omitting "motor cycle licence issued on or after 1 July 2007 (other than learner licence)" from column 2 of item 153C in the table and substituting "P1 provisional licence issued on or after 1 July 2007 in relation to a motor cycle"; (i) by omitting "10(3)" from column 2 of item 153C in the table and substituting "10(2)"; (j) by omitting "motor cycle licence issued before 1 July 2007 (other than learner licence)" from column 2 of item 153D in the table and substituting "P1 provisional licence issued before 1 July 2007 in relation to a motor cycle". Displayed and numbered in accordance with the Rules Publication Act 1953.

These regulations are administered in the Department of Infrastructure, Energy and Resources.
EXPLANATORY NOTE
(This note is not part of the regulation) These regulations amend the
(a) by prescribing certain offences for the purposes of section 43H of the Traffic Act 1925 ; and (b) to update references to 1st year provisional drivers; and (c) to provide for the issue of a traffic infringement notice in relation to a learner driver driving without an accompanying person as required and a learner failing to display L-plates; and (d) by replacing certain references, in respect of certain offences, to motor cycle licences with references to P1 provisional licences in relation to motor cycles.
