Act No. 22, 1979.

An Act to amend the Traffic Authority Act, 1976, to increase the membership of the Traffic Authority and for certain related purposes; and to deem certain acts and proceedings of the Authority not to have been invalidated by reason that certain persons have acted as members. lAssented to, 24th April, 1979.1

Traffic Authority (Amendment).

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.          This Act may be cited as the “Traffic Authority short title.

(Amendment) Act, 1979”.

2.      (1) Except as provided in subsection (2), this Act shall Commcncc-

commence on the date of assent to this Act.

(2) Sections 3 and 4 and Schedule 1 shall commence on

such day as may be appointed by the Governor in respect thereof

and as may be notified by proclamation published in the Gazette.

3. The Traffic Authority Act, 1976, is amended in the manner Amendment

set forth in Schedule 1.

Sec. 3.

SCHEDULE 1.

Amendments to the Traffic Authority Act,

1976.

(1) (a) Section 7 (1) (a )—

Omit “4 official members”, insert instead “5 official members”.

(b) Section 7 (1) (a) (iii)—

Omit “and”.

(c) Section 7 (1) (a) (v)—

After section 7 (1) (a) (iv), insert :—

(v)   the Chief Commissioner of the Public Transport Commission of New South Wales; and

(d)

Section 7 ( 1 )

(b )—

Omit “2 appointed members”, insert instead “4 appointed members”.

(e) Section 7 (1) (b) (i)—

Omit “and”.

(f) Section 7 (1) (b) (ii) —

Omit “generally.”, insert instead “generally;”.

(g) Section 7 (1) (b) (iii), (iv) —

After section 7 ( 1 ) (b) (ii), insert :—

(iii)   one shall be appointed by the Minister, on the nomination of the Executive Committee of the Transport Workers’ Union of Australia (New South Wales Branch), to represent transport industry interests generally; and

(iv)   one shall be appointed by the Minister as his personal representative.

(h) Section 7 (4 )—

Omit “Council or Associations”, insert instead

“Council, Associations or Union”.

(2) (a) Section 8 (2) (a )—

Omit “or” where secondly occurring.

(b) Section 8 (2) (b )—

Omit “member referred to in section 7 (1) (b) (ii),”, insert instead “appointed member referred to in section 7 (1) (b) (ii);”.

(c) Section 8 (2) (c), (d )—

After section 8 (2) (b), insert;—

(c)

appoint, on the nomination of the Executive Committee of the Transport Workers’ Union of Australia (New South Wales Branch), a person to be the deputy of the appointed member referred to in section 7 ( 1 ) (b) (iii);

(d)

appoint a person to be the deputy of the appointed member referred to in section 7 (1) (b) (iv),

(d) Section 8 (4 )—

Omit “elected”, insert instead “appointed”.
