s1 2 s4 Traffic Amendment (No. 2) No. 350, 1998 ˙ Short title 1. This regulation may be cited as the Traffic Amendment Regulation (No. 2) 1998 . ˙ Commencement 2. This regulation commences on 1 March 1999. ˙ Regulation amended 3. This regulation amends the Traffic Regulation 1962 . ˙ Replacement of s 50 (Speed limits) 4. Section 50— omit, insert— ˙ ‘ Obeying the speed limit ‘ 50.(1) A person must not drive a motor vehicle at a speed over the speed limit applying to the road where the person is driving. Maximum penalty—20 penalty units. ‘ (2) The speed limit applying to a road is— (a) if the road in a local traffic area—40 km/h; or (b) if a speed restriction sign applies to the road—the number of kilometres per hour indicated by the number on the sign; or (c) otherwise—the default speed limit. ‘ (3) A speed restriction sign on a road applies to the road— (a) from the sign; and (b) to the nearest of the following— (i) a speed restriction sign on the road with a different number on the sign; (ii) an end speed restriction sign on the road;
s4 3 s4 Traffic Amendment (No. 2) No. 350, 1998 (iii) if the road ends at a T-intersection or dead end—the end of the road. ‘ (4) A speed restriction sign on a road does not apply to another road that intersects with the road. ‘ (5) Despite subsection (2), a person must not drive— (a) an excess dimension vehicle, that is required to be escorted by a pilot vehicle, at a speed over 80 km/h; or (b) a road train at a speed over 90 km/h. ‘ (6) In this section— “default speed limit” means— (a) for a road in a built-up area— (i) if the road is in a lower speed limit area—50 km/h; or (ii) otherwise—60 km/h; or (b) for a road that is not in a built-up area—100 km/h. “end speed restriction sign” means an official traffic sign inscribed with words indicating the end of a speed restriction. “lower speed limit area” means the areas of the following local governments— (a) Brisbane City Council; (b) Caboolture Shire Council; (c) Caloundra City Council; (d) Gold Coast City Council; (e) Ipswich City Council; (f) Logan City Council; (g) Maroochy Shire Council; (h) Noosa Shire Council; (i) Pine Rivers Shire Council; (j) Redcliffe Shire Council; (k) Redland Shire Council.’.
