Traffic Amendment Act 2003

An Act to amend the Traffic Act 1925

[Royal Assent 15 December 2003]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Traffic Amendment Act 2003 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Traffic Act 1925 is referred to as the Principal Act. 4Section 59 amended (Traffic signs) Section 59 of the Principal Act is amended as follows: (a) by omitting subsection (1) and substituting the following subsections: (1)  The Commission may issue directions for the use of traffic signs – (a) on or near public streets; and (b) on or in vehicles on public streets. (1A)  A direction referred to in subsection (1) may be given to any of the following: (a) a highway authority; (b) a prescribed authority; (c) any other person or class of persons. (1B)  A person referred to in subsection (1A) must comply with a direction issued by the Commission.

Penalty:  Fine not exceeding 10 penalty units.

(b) by omitting from subsection (2) "highway authorities and such other authorities as may be prescribed" and substituting "an authority or person referred to in subsection (1A) "; (c) by omitting from subsection (3) "Every highway authority and such other authority as may be prescribed" and substituting "An authority or person referred to in subsection (1A) "; (d) by inserting in subsection (4) "or placed on or in any vehicle on any public street" after "street"; (e) by inserting the following penalty after subsection (4) :

Penalty:  Fine not exceeding 10 penalty units.

(f) by inserting in subsection (5) "or is on or in any vehicle on or near any public street" after "street"; (g) by inserting in subsection (5) "or vehicle" after "such land"; (h) by inserting in subsection (6) "or enter into such vehicle" after "land".
