Traffic (Amendment) Ordinance 1981

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Ac/ministration) Act 1910.

An Ordinance to amend the Traffic Ordinance 1937

Short title

1. This Ordinance may be cited as the Traffic (Amendment) Ordinance 1981. 1

2. After section 23 of the Traffic Ordinance 19372 the following section is

inserted:

Anzac Day parades

"23A. (1) Where—

(a)

a person is taking part, or attempts to take part, in an Anzac Day parade; and

(b)

there are reasonable grounds for believing that the person is likely to commit an offence against sub-section (3),

the Australian War Memorial on 25 April in any year;

a member of the Australian Federal Police of or above the rank of Sergeant

may direct the person not to take part in the parade.

"(2) A person who contravenes a direction given under sub-section (1) is

guilty of an offence and punishable, on conviction, by a fine not exceeding $100.

"(3) A person who—

(a) disturbs or disrupts—

(i) an Anzac Day parade; or

(ii)  an observance or ceremony conducted at the building known as

(b)

acts in a manner likely to disturb or disrupt such a parade, observance or ceremony; or

(c)

engages in conduct offensive or insulting, or likely to give offence or cause insult, to persons taking part in such a parade, observance or ceremony,

is guilty of an offence punishable, on conviction, by a fine not exceeding $100.
"(4) In this section, a reference to an Anzac Day parade shall be read as a
reference to a parade of persons on 25 April in any year organized by The
Returned Services League of Australia, and includes a reference to such a

parade of persons assembled at or near the building known as the Australian

War Memorial.".
