AN ORDINANCE

To amend the Traffic Ordinance 1937

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Adminis­ tration) Act 1910.

TRAFFIC (AMENDMENT) ORDINANCE 1978

1. This Ordinance may be cited as the Traffic (Amendment) Ordinance 1978.*

2. In this Ordinance, "Principal Ordinance" means the Traffic

Ordinance 1937. t

3. Section 4 of the Principal Ordinance is amended by omitting " 'public street ' and ' t h e Registrar' " and substituting " 'off-street parking area ' , 'public street ' , ' road marking' , ' t he Registrar ' and ' traffic sign ' ".

4. Section 25 of the Principal Ordinance is amended by inserting in sub-section (1) " Part V I I A , " after " the provisions of ".

and N o . 39, 1974.

5.   Section 26 of the Principal Ordinance is amended—

(a)

by omitting " section fifty-six N " from the definition of " pedestrian crossing " in sub-section (1) and substituting

"sub-section 126 ( 3 ) " ;

(b)

by omitting from sub-section (1) the definitions of "road marking" and "traffic lights" and substituting the follow­ ing definition:

" ' traffic lights ' means a traffic sign consisting of—

(a)

traffic lights erected on, near or above a public street; and

(b)

a road marking comprising a line marked across or partly across the public street at, near or below those traffic lights."; and

(c) by adding at the end thereof the following sub-sections:

" (5) A reference in this section to a pedestrian includes a reference to a person riding or wheeling a bicycle other­ wise than on a bicycle path.

" (6) A reference in this section, other than sub-section ( 4 ) , to a public street includes a reference to an off- street parking area.".

6. Section 28 of the Principal Ordinance is amended by adding at

the end thereof the following sub-section:

" (3) A reference in sub-section (1) to a public street includes a

reference to an off-street parking area.".

7 . Section 29 of the Principal Ordinance is amended by omitting from sub-section (2) " section seventy-four A " and substituting " section 183 ".
