Traffic Acts Amendment Act of 1967
404 ANNO SEXTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 44 of 1967 An Act to Amend "The Traffic Acts, 1949 to 1965," in certain particulars [ ASSENTED TO 19TH DECEMBER, 1967] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice a nd consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. (1) Short title . This Act may be cited as " The Traffic Acts Amendment Act of 1967." (2) Principal Act. " The Traffic Acts, 1949 to 1965," are in this Act referred to as the Principal Act. (3) Collective title . The Principal Act and this Act maybe collectively cited as " The Traffic Acts, 1949 to 1967." 2. Amendments of s. 39. Section thirty-nine of the Principal Act is amended by- (a) in subsection (1) inserting in paragraph (b) after the words " against this Act " the symbols and words ", including an offence against this section,";
Traffic Acts Amendment Act of 1967, No. 44 405 (b) in subsection (2)- (i) omitting paragraph ( b) and inserting in its stead the following paragraphs:- (bb)) fails to produce forthwith any driver ' s license issued to him under this Act; or (c) fails to produce forthwith any license , other than a driver's license, issued to him under this Act; or"; (ii) re-lettering paragraphs ( c), (d), and ( e) as paragraphs ( d), (e) and (f) respectively; (iii) omitting from paragraph ( d), as re-lettered by this Act, the words " or refuses "; (iv) omitting from paragraph ( f), as re-lettered by this Act, the words " without reasonable cause "; and (v) adding the words " unless, in the case of a failure referred to in paragraph (c) or (f) of this subsection , he has reasonable cause for such failure ". (c) adding the following subsection:- " (3) Notwithstanding the provisions of subsection (2) of this section a licensee required by a member of the Police Force to produce any driver ' s license issued to him under this Act shall be deemed not guilty of an offence if not later than forty - eight hours after being required so to do he produces such license to the Officer in Charge of the Police Station specified by that member of the Police Force.".
