157 (Quecnslanh ANNO UNDECIMO ELIZABETHAE SECUNDAE REGINAE I I I e I I I I I I I I I I • I I I I I I I I I I I I I I I • I I I I I I I I I I I I I I I I I I I I • No. 23 of 1962 An Act to Amend "The Traffic Acts, 1949 to 1961," in certain particulars [ASSENTED TO 10TH DECEMBER, 1962J BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short tide. This Act may be cited as "The Traffic Acts Amendment Act of 1962." (2) Principal Act. "The Traffic Acts, 1949 to 1961," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as "The Traffic Acts, 1949 to 1962."
158 Traffic Acts Amendment Act of 1962, No. 23 2. Amendment of s. 1211. Section 12H of the Principal Act is amended by in subsection (7) inserting in paragraph (b) after the word "official" the word "traffic". 3. Amendments of s. 44F. Section 44F of the Principal Act is amended by- (a) in subsection (I) inserting after the words "member of the Police Force" the words "or authorised person"; (b) in subsection (2) omitting the words "by a member of the Police Force"; and (c) adding the following subsection:- "(3) For the purposes of this section "authorised person" means a person who is authorised in writing by the Town Clerk to- (a) affix on a vehicle in a conspicuous position; or (b) give to the owner or driver of a vehicle, the notice in writing prescribed by subsection (I} of this section in any and every case where the vehicle is found by him parked in contravention of this Part of this Act or the vehicle is found by him in any other circumstances which constitute or are deemed to constitute an offence in relation to metered parking." 4. Ameadmeat of s. 44L Section 44L of the Principal Act is amended by adding the following subsections:- "(I0) Any offence under this Act (other than an offence in relation to metered parking) in relation to the parking, stopping, or standing in any part of the Traffic Area during the fixed hours of any vehicle and/or horse, which pursuant to section 45A of this Act is prescribed by the regulations to be a minor traffic offence, shall be deemed to be an offence in relation to parkatarea parking and a contravention of the provisions of this Part of this Act. (11) In applying as prescribed by section 45A of this Act the provisions (in this subsection called the "said provisions") of subsections (2) and (3) of section 44F, and of section 44G of this Act to offences under this Part of this Act in relation to parkatarea parking (including offences deemed by subsection (IO) of this section to be offences in relation to parkatarea parking) which pursuant to the said section 45A are prescribed by the regulations to be minor traffic offences, the said provisions shall, additienally to the modifications and adaptations prescribed by the said section 45A apply by reading any references therein to the Town Clerk as referring to the Traffic Engineer."

Section seventy-one of the Principal Act is amended by- (a) in subsection (l) inserting after the word "Proclamations" the words ", Orders in Council"; and (b) in subsectior. (2)- (i) inserting in the first paragraph after the word "Proclamations" the words ", Orders in Council"; and (ii) inserting in. the second paragraph after the word "Proclamation", wherever occurring, the words ", Order in Council,". 159
