THE TRAFFIO [ASSENTED TO 19TH OCTOBER, 1933.] A ACTS MENDMENT B E it enacted by the King's Most Excellent ~ \ {ajesty, ACT OF 1933. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1.) This Act may be cited as " The Traffic Acts Short title Amendment Act of 1933," and shall be read as one with : ~ ! truction. *" The Traffic Acts, 1905 to 1928," herein referred to as the Principal Act. (2.) The Principal Act and this Act may collectively~ ollective be cited as " The Traffic Acts, 1905 to 1933." tItle. Amendments of the Principal Act. 2. Section 3A of the Principal Act is amended as Amendmenl follows :_ of s. 3A. Paragraph (a) is repealed and a new paragraph (a) is inserted in lieu thereof, namely :- " (a) Constitute the Area or part or parts of the Area of any City, and/or Town, and/or Shire, or two or more of such Areas and/or part or parts of such Areas which are conterminous, together with any bridge which is situated at the boundary of any Area or Areas, and/or part or parts of any Area or Areas, a Traffic District for the purposes of this Act by such name as he thinks proper." 3. Section 16A of the Principal Act is amended as Amendment follows :_ of s. 16A. (a) The following provision is inserted after the third paragraph of the said section, namely:- "The term "license" in this section shall mean and include a license, whether issued under this Act, or any license, permit, registration, endorsement, or by whatever name called, which is issued or granted under any other Act or law, and which is required or necessary * 5 Edw. (b) The following provision is added to section 16A of the Principal Act, as follows:- "Notwithstanding anything in this Act or inanyother Act to the contrary, the provisions of this section shaH extend and have force and operation throughout the State of Queensland, and to the intent that such provisions shall so apply and extend whether in a Traffic District or not." New ss.16B 4. The following new sections 16B and 160 are and 160. inserted after section 16A of the Principal Act, as follows:- Duty to stop "[16B.] (1.) If in any case, owing to the presence of : cc~ ~ : ~ f a motor vehicle on a road, an accident occurs whereby damage or injury is caused to any person, or to any vehicle or animal or any property, the driver of the motor vehicle shall stop and, if required so to do by a member of the Police Force or by any person having reasonable grounds for so requiring, give his name and address, and also the name and address of the owner and the identification marks of the vehicle. The driver of the vehicle shall, where injury is caused to any person, render all reasonable assistance to such injured person. (2.) If, in the case of any such accident as aforesaid, the driver of the. motor vehicle for any reason does not give his name and address to any such person as aforesaid, he shall report the accident at a police station or to a member of the Police Force as soon as reasonably practicable, and in any case within twenty-four hours I of the occurrence thereof. (3.) Any person who fails to comply with the provisions of this section shall be guilty of an offence and shall be liable to a penalty not exceeding fifty pounds: Provided that, where injury (whether fatal or non-fatal) is caused to any person under the above circumstances, and the driver of the motor vehicle knowingly acts in contravention of this section, such driver shall be guilty of an offence and liable to a penalty not exceeding one hundred pounds or to imprisonment
TRAFFIC. 14771 Traffic Acts Amendment Act. for six months, or to both such fine and such imprisonment, any Act or law to the contrary notwithstanding. The Court may also cancel the license of any person found guilty of a breach of this section, and in the event of such cancellation such person shall not again be entitled to apply for a license to drive or operate any motor vehicle under this Act or any other Act or law until a period of twelve months from the date of the sentence of the Court has elapsed. (4.) In this section the expression "animal" means any horse, cattle, ass, mule, sheep, pig, goat, or dog. (5.) This section shall be in aid of and not in derogation of *" The Criminal Code," t" The State Transport Act of 1932," t" The Heavy Veh1"cles Acts, 1925 to 1931," §" The .. ~ . lain Roads Acts, 1920 to 1929," or any other Act relating to traffic or transport. (6.) The term " motor vehicle" shall mean and Mot.or include any vehicle propelled by gas, motor spirit, oil, vehICle. electricity, steam, or any other motive power, and used or intended to be used on any public highway or road; the term includes motor bicycle and motor cycle, but does not include a railway or tramway locomotive, tram motor, tram car, fire engine, fire reel, or traction engine. The term "license" in this section shall mean and License. include a license whether issued under this Act, or any license, permit, registration, endorsement, or by whatever name called, which is issued or granted under any other Act or law and which is required or necessary under any such Act or law before a person is allowed or permitted to drive or operate a motor vehicle. (7.) Notwithstanding anything in this Act or in any other Act to the contrary, the provisions of this section shall extend and have force and operation throughout the State of Queensland, and to the intent that such provisions shall so apply and extend, whether the accident occurs in a Traffic District or not. * 63 Vie. 'Where an accident arises out of the· presence of a motor vehicle on a road, the Minister may direct that an inquiry be made into the cause of the- accident. (2.) Where any such accident has occurred, any person authorised by the Minister in that behalf may, on production, if so required, of his authority, inspect any vehicle ·in connection with which the accident arose, and for that purpose may "enter at any reasonable time any premises where the vehicle is, and if any person obstructs any person so authorised in the performance- of his duty under this subsection, he shall be guilty of an offence, and be liable to a penalty not exceeding fifty pounds. (3.) If in any case the Minister considers that any inquiry so directed by him to be made under this section should be made by means of the holding of a public inquiry, he may direct a public inquiry to be held. which public inquiry shall be held by such person or persons appointed in that behalf by the Governor in Council. For the purposes of such inquiry the person or. persons appointed to hold same shall have all the powers, authorities, and protection of a Commission under *" The Official Inquiries Evidence Acts, 1910 to 1929." (4.) Any report made to the Minister as the result of an inquiry under this section shall not be used in evidence by or on behalf of any person by or against whom any legal proceedings are instituted in consequence of the accident to which the inquiry relates. (5. ) Notwithstanding anything in this Act or in any other Act to the contrary, the provisions of this section shall extend and have force and operation throughout the State of Queensland, and to the intent that such provisions shall so apply and extend, whether the accident occurs in a Traffic District or not." 5. The Schedule to the Principal Act is amended as follows:- Clause two is amended by adding after the word "vehicles," where such word twice occurs, the words "or velocipedes"; also by adding after the words "such vehicle" the words "or velocipede." * 1 Geo.
