AN ACT to amend the Traffic Act, 1919-1973.

[Assented to 19th September, 1974.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Traffic Act

and citation.

Section 4

Subsection (1) of section 4 of the principal Act

is amended by adding after the interpretation

"passenger vehicle" the following interpretation

"recording fee" means the fee payable under subsection (1) of section eleven of this Act; .

Section 5

amended.

Section 5 of the principal Act is amended

(a)	by adding after the words "license fee" in line three of subsection (4) the words "and the recording fee";
(b)	by deleting the word "fee" in line six of subsection (4) and substituting the word "fees";
(c)	by adding after the words "license fee" in line five of subsection (5) the words "and the recording fee"; and
(d)	by deleting the word "fee" in line seven of subsection (5) and substituting the word "fees".

Section 9

5. Section 9 of the principal Act is amended

(a)	by deleting the words "prescribed fee" in line seven of subsection (1) and substituting the words "recording fee and appropriate license fee";
(b)	by deleting the word "fee" in line two of paragraph (d) of subsection (6) and substituting the words "license fee and recording fee"; and

(c) by deleting the passage ", except where the license is granted or renewed under subsection (4) of this section for a period exceeding six months, with a further sum of one dollar" in lines thirteen, fourteen fifteen and sixteen of subsection (10), and substituting the words "with the recording fee".

Section 11 of the principal Act is amended—

(a)	by repealing subsection (1) and substitut- ing the following subsections

(1) Notwithstanding any other provi- sion of this Act, the recording fee specified in Part I of the Third Schedule to this Act shall be paid to the local authority for the grant or renewal of any license for a vehicle, irrespective of whether the whole or any part of a license fee is also payable for the grant or renewal of the license.

(la) The transfer fee specified in Part II of the Third Schedule to this Act shall be paid to the local authority for effecting the transfer of any license for a vehicle.

(lb) Subject to the exemptions and concessions provided in the succeeding provisions of this section, the appropriate fee specified in Part III of the Third Schedule to this Act (hereinafter referred to as a "license fee") shall be paid to the local authority for granting or renewing any license for a vehicle. ;

(b)	by adding immediately before the words "the Third" where occurring in-

(i) line two of paragraph (a) of subsection (3b);

(ii) the penultimate line of paragraph (b) of subsection (3b);

(iii) line three of paragraph (c) of subsection (3b);

(iv)	the penultimate line of subsection (4);

(v) line three of subsection (5);

(vi) line three of subsection (5a);

(vii) line six of subsection (7),

the passage "Part III of", in each case; and

(c)	by adding immediately before the word "fee" where it occurs-

(i) in the last line of subsection (6); and

(ii) in line two, in line three, twice in line eleven, twice in line twelve, and in line thirteen of subsection (8),

the word "license", in each case.

Section 11B

Subsection (1) of section 11B of the principal Act is amended by deleting the words "fee for the issue or renewal of a vehicle license is" in lines one and two and substituting the words "fees for the issue or renewal of a vehicle license are".

Section 14	8.	Section 14 of the principal Act is amended

(a)	by deleting the passage "subsections (2) and (5)" in line one of subsection (1) and substituting the passage "subsection (2)";
(b)	by repealing subsection (2) and substitut- ing the following subsections

(2) A local authority may, during the financial year ending on the thirtieth day of June, 1975, in the manner from time to time approved by the Minister administering the Main Roads Act, 1930-

(a) retain an amount in respect of the motor vehicles on its regis- ter, as at the thirty-first day of December, 1974, being-

(i) in the case of a local

authority not being the

respect of each motor vehicle up to and in- cluding one thousand vehicles, and seventy-five cents in respect of each motor vehicle in excess of that number; and

(ii) in the case of the Director —seventy-five cents in respect of each motor vehicle;

(b)	retain any recording fees paid to it during that financial year.

(2a) Every local authority may, dur- ing any financial year subsequent to the financial year ending on the thirtieth day of June, 1975, retain, in the manner from time to time approved by the Min- ister administering the Main Roads Act, 1930, the amount of any recording fee paid to it during such financial year. ; and

Section 16

Subsection (1) of section 16 of the principal Act is amended by adding immediately before the words "the Third" in line five of paragraph (b) the passage "Part III of".

10. Subsection (1) of section 20 of the principal amended.

Act is amended by deleting the words "payment of the prescribed fee issue to every applicant for a vehicle license" in lines four and five, and substi- tuting the words "the issue or renewal of any vehicle license issue to the applicant".

12. Subsection (1) of section 21J of the princi-

pal Act is repealed and re-enacted as follows

(1) Where, under the provisions of this Act, a license for a vehicle shall or may be granted, extended or renewed without payment of the license fee

(a)	the license shall not be so granted, extended or renewed unless the record- ing fee has been first paid to the local authority; and
(b)	the local authority shall, when grant- ing, extending or renewing a license, issue to the owner of the vehicle a certificate of registration, without further payment, which shall have effect for the duration of the license in respect of which it is issued. .

Section 23D

13. Section 23D of the principal Act is

amended (a) by repealing and re-enacting subsection (1)

as follows

(1) Subject to any other provisions of this Act a driver's license is valid for a period of twelve months or of three years, according to the period for which it is expressed to be issued or renewed,

from the date of issue or renewal, and may be renewed from time to time for a further period of twelve months or of three years within one month before, or within twelve months after, its ex- piry. ; and

(b)	by deleting the passage "Part III" in sub- section (3) and substituting the passage "Part IV".

Section 23E

14. Section 23E of the principal Act is amended

(a)	by deleting the passage "Part III" in sub- section (1) and substituting the passage "Part IV"; and
(h)	by adding after subsection (1) the follow- ing subsection

(la) A driver's license shall not be issued or renewed for a reduced fee pursuant to this section other than for a period of twelve months. .

The recording fee payable under subsection (1) of section

eleven shall be a fee of four dollars.

TRANSFER FEE.

A fee of three dollars is payable upon the transfer of any

license for a vehicle.

PART III—Section B.

RULES FOR DETERMINING POWER UNITS AND TARE WEIGHT FOR THE PURPOSES OF SECTION A OF PART III OF THIS SCHEDULE.

For the purposes of ascertaining the fees under Section

A of this Part

(a)	the number of power units of a motor vehicle (other than a motor vehicle with a rotary type engine) shall be the number of horsepower calculated from the R.A.C. formula expressed as the whole number so obtained or such other formula as the Minister may from time to time determine;
(b)	the R.A.C. formula is the square of the diameter of the cylinders (expressed in millimetres) multi- plied by the number of cylinders and the result divided by 1 613; and
(c)	the tare weight of a vehicle shall-

(i) in the case of a new or unlicensed vehicle— be based on the manufacturer's specification; and

(ii) in the case of a vehicle which has been pre- viously licensed—be as shown on the licence.

PART IV.

FEES RELATING TO DRIVERS' LICENSES.

The following fees are payable

(a)	on the first application for a driver's license and on every subsequent appli- cation made after three months from the refusal, or made after the cancella- tion, of any such license ...	4.00
(b)	on the issue, or renewal, of a driver's license (other than such as is appropri- ate to the passenger vehicle class only) for each period of twelve months for which the license is issued or
