AN ACT to amend the Traffic Act, 1919.
[Assented to 31st December, 1924.]

this present Parliament assembled, and by the authority of
the same, as follows:-

| commencement. | ment Act, 1924, and shall he read as one with the Traffic Act, 1919, hereinafter referred to as the principal Act. |
| (2.) This Act shall (except as provided in section four) come into operation on the first day of January, one thousand nine hundred and twenty-five. |
| Amendment of | 2. | Section four of the principal Act is hereby amended, |
| Section 4. | as follows: |
By inserting an interpretation of the words "motor
omnibus," as follows :—
"Motor omnibus" means a motor vehicle used as a passenger vehicle and having seating capacity for not less than eight passengers (exclusive of the driver and conductor), and plying for hire at a fare for each passenger.

Amendment of
(1.) A head-line is inserted in the Third Schedule to the principal Act, as follows:—"Part I."; and the decimal point after the figures 200 in the last line of paragraph 3 of the Rules for ascertaining power weight in the said Schedule is omitted.

(2.) The following words and figures are inserted in the Third Schedule to the principal Act after the fees for "Trans- fers" and before the "Rules for ascertaining power weight and power load weight," namely:—
Part II.
As from and including the first day of January, 1925, in the case of a motor omnibus for which a passenger vehicle license is granted or held, the following additional license fees shall be payable, namely :—
(1) If the motor omnibus is used within the metropolitan area as prescribed under section thirteen, and within two miles of the Town Hall, Perth, or the Town Hall, Fremantle, the additional fee shall be
| (a) | if the motor omnibus is fitted with tyres other than pneumatic tyres, a fee calcu- lated at the rate of £2 for each passenger the motor omnibus is licensed to carry. |
| (b) | if the motor omnibus is fitted with no tyres other than pneumatic tyres, a fee calcu- lated at the rate of £1 10s. for each pas- senger the motor omnibus is licensed to carry. |
(2) If the motor omnibus is used within the metropolitan area, but not within two miles of the Town Hall of Perth, or the Town Hall of Fremantle, the additional fee shall be a fee calculated at the rate of two-thirds of the respective fees above men- tioned, according to whether the motor omnibus is, or is not, fitted with any tyres other than pneumatic tyres.
Such additional license fees shall be apportioned if the license has effect for a period commencing on or after the first day of the seventh month of the financial year, so that the licensee shall only be required to pay one-half of the additional fee ; or it has effect for a period commencing on or after the first day of the tenth month, one-fourth of the addi- tional fee.
The amount of such additional license fee shall be a debt due to the Minister from the licensee and recoverable by action in any court of competent jurisdiction.

(3.) After Part II. of the Third Schedule (inserted by this section) the words and figures "Part III." are inserted as a head-line to the Rules for ascertaining power weight and power load weight.

| (2.) On the publication of such proclamation in the Gaz- ette there shall be substituted for Part I. of the Third Sche- dule to the principal Act a Part, as follows:— |

The weight per cwt. being in each ease that of the vehicle and the
load weight.
Provided that if it is proved to the satisfaction of the licensing authority that
the license is required for a cart which is used only on occasions by a farmer or
settler or wool grower in carrying goods and materials to and from his own farm,
the fee shall be at the rate of one-fourth of the prescribed rates with a minimum
fee of 15s.:
Provided also that in the case of carts used by or for bona ,fide prospectors or
sandalwood carters, if it is proved to the satisfaction of the licensing authority
that such carts are rarely used on main roads, the fee shall be 15s.

For a trailer, 10s. per ton per wheel on the weight of trailer, plus
declared maximum load.
All motor vehicles and all wagons or engines using approved cushion tyres (neither solid nor pneumatic) to be charged an additional 10 per cent.
All motor vehicles (other than motor omnibuses) and all wagons or
engines using solid rubber tyres to be charged an additional
20 per cent. of the above fees.
All motor vehicles (other than motor omnibuses), and all wagons or
engines using metal tyres to be charged an additional 40 per
cent. of the above fees.
If any substance other than petrol is used for power for motor vehicles, motor or steam wagons, or locomotive or traction engines, an additional 20 per cent. Of the above fees shall be charged.

For the purposes of this Schedule ” load " means the greatest load which is within t e limits ot the vehicle's capacity, as ascertained according to the prescribed method.
All the above fees are payable annually.
