TRAFFIC ACT 1909—REGULATION
(Relating to the wearing of protective helmets by persons
travelling on motor cycles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 January 1992.
Amendment
2. The Motor Traffic Regulations 1935 are amended:
| (a) | by omitting Regulation 110E (2)–(10) and by inserting instead the following clause: |
(2) Clauses (1) and (1A) do not apply to any person who is travelling in an enclosed hard-top cabin attached to, and forming part of, a motor tricycle.
(b) by omitting items 31 and 32 from Schedule A.

EXPLANATORY NOTE
The object of thls Regulation is to amend the Motor Traffic Regulations 1935 so as to require that a protective helmet be worn by all riders of motor cycles and all passengers on motor cycles (other than passengers being carried in an enclosed had-top cabin). Previously, certain exemptions (for example, on medical grounds) were available.
The Regulation also makes a consequential amendment.
