TRAFFIC ACT 1909—REGULATION

(Relating to the use of skateboards and similar toy vehicles on public streets)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 3rd May 1991.

Amendments

2. The General Traffic Regulations 1916 are amended by inserting

after section 3A the following section:

SECTION 3B—TOY VEHICLES

Use of toy vehicles on public streets

1. (1) In this Regulation, “toy vehicle” means a vehicle (other than a bicycle) ordinarily used by a chiId at play or by an adult for recreational or sporting purposes which is designed to be propelled by human power, and includes a scooter, a skateboard, roller-skates and similar toys.

(2) A person is not to ride in or on, or to cause, permit or allow another person to ride in or on, a toy vehicle on a public street between sunset and sunrise on successive days.

(3) A person is not at any time to ride in or on, or to cause, permit or allow another person at any time to ride in or on, a toy vehicle on the carriageway of a public street on or adjacent to a centre line, a lane line or a median strip.

(4) A person must not ride in or on a toy vehicle on a public street

while the toy vehicle is attached to another vehicle.

(5) A person riding in or on a toy vehicle on a public street must not

permit the toy vehicle to be drawn by another vehicle.

(6) Nothing in this Regulation prohibits a toy vehicle from being

ridden across a marked footcrossing or a children’s footcrossing.

EXPLANATORY NOTE

The object of this Regulation is to amend the General Traffic Regulations 1916 so as to regulate the use of toy vehicles, including scooters, skateboards, roller skates and similar toys, by:

(a) prohibiting their use on public streets between sunset and sunrise; and

(b)

prohibiting their use on part of the carriageway of a public street that is marked with a centre or lane line or on which there is a median strip; and

(c)

prohibiting their attachment to or their being drawn by other vehicles on public streets.

The Regulation does not prevent toy vehicles being ridden across marked

footcrossings or children’s footcrossings.
