TRAFFIC ACT 1909—REGULATION
(Relating to the use of crimson flashing warning lamps)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 April 1994.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a) byinsertingbeforeRegulation95Athefollowingregulation: Use of crimson flashing warning lamps on certain council vehicles 95AA. (1) Without limiting the operation of Regulation 95 (6) (d) (i), a person must not cause or permit any lamp permitted to be fixed to a motor vehicle by paragraph 42A (a) or 149 (a) of Schedule F to be lighted unless the vehicle is being used by an employee of a council of a local government area for the purposes of enforcing excess weight limits legislation.
(2) In this Regulation, “excess weight limits legislation”
means any of the following:
(a)
sections108and112,andDivision2ofPart14,ofthe Roads Act 1993;

(c)
theRoads(WeightofLoadsonRoadsotherthanMain Roads) Transitional Regulation 1993.

byinsertinginparagraph42A(a)ofScheduleFafterthewords “vehicles used by the Roads and Traffic Authority vehicles used by an employee of a council of a local government area for the purposes of enforcing excess weight limits legislation (within the meaning of Regulation 95AA (2))”;
(c)

EXPLANATORY NOTE
The object of this Regulation i s to allow vehicles used by employees of a council of a local government area for the purposes of enforcing excess weight limits to display crimson flashing warning lamps while those vehicles are being used for such purposes.
This Regulation is made under the Traffic Act 1909, including section 3 (1) (c)
and (2) (d).
