TRAFFIC ACT 1909—REGULATION

(Relating to the tinting of windows of motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended by omitting

paragraph 68 (5) (b) of Schedule F and by inserting instead the following:

(b)

any part of the glazing of a window (other than a windscreen) or interior partition of a motor vehicle which was first registered (whether or not in New South Wales) before 1 August 1994, if that part of the glazing has a luminous transmittance of not less than:

(i) 35 per cent (except when sub-paragraph (ii) applies); or

(ii)  the luminous transmittance it had immediately before 1 August 1994 if it had a luminous transmittance of less than 35 per cent at that time.

EXPLANATORY NOTE

The object of this Regulation is to alter an exemption from the window tinting (light transmission) restrictions inserted in the Motor Traffic Regulations 1935 (commencing on 1 August 1994). The exemption currently applies to the windows (excluding windscreen) and interior partitions of motor vehicles first registered before 1 August 1994. This Regulation alters the exemption so that it will only permit tinting for those vehicles to a minimum light transmission of 35 per cent while permitting existing heavier tints on those vehicles (tinting done before 1 August 1994 having a light transmission below 35%) to remain in place.

This Regulation is made under the Traffic Act 1909, including section 3 (the general

regulation making power).
