TRAFFIC ACT 1909—REGULATION

(Relating to the tinting o f windows of motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 August 1994.

Amendments

2. The Motor Traffic Regulations 1935 are amended:

(a)

by omitting paragraph 68 (5) (b) of Schedule F and by inserting instead the following sub-subparagraphs:

(b) any part of the glazing of a window (other than a windscreen) or internal partition of a motor vehicle which was first registered (whether or not in New South Wales) before 1 August 1994;

(b1) any part of the glazing of a window (other than a windscreen) or interior partition of a motor vehicle which was first registered (whether or not in New South Wales) on or after 1 August 1994, if:

(i)  that part of the glazing has a luminous transmittance of not less than 35 per cent; and

(ii)  the motor vehicle is equipped with an external rear vision mirror, or external rear vision mirrors, complying with the requirements of paragraph 73;

(b) by omitting paragraph 68 (7) of Schedule F.

EXPLANATORY NOTE

The objects of this Regulation are:

(a)

to create an exemption from the window tinting (light transmission) restrictions in the Motor Traffic Regulations 1935 for motor vehicles first registered (whether or not in New South Wales) before 1 August 1994 (the exemption does not apply to the windscreens of those vehicles); and

(b)

to extend an existing exception from the window tinting restrictions in the Regulations which currently applies to windows to the rear of the driver of a motor vehicle and permits a minimum light transmission of 35 per cent, so that the exception also applies to windows on either side of the driver of a motor vehicle first registered (whether or not in New South Wales) on or after 1 August 1994; and

(c)

to remove the existing prohibition on the coating of motor vehicle windows and windscreens (on the basis that the prohibition has been supplanted by the other tinting and reflective restrictions in the Regulations).

This Regulation is made under the Traffic Act 1909, including section 3 (the general

regulation making power).
