TRAFFIC ACT 1909—REGULATION
(Relating to the riding of certain motor cycles by holders of learners’ or
provisional licences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 March 1993.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a) by inserting after Regulation 12 (5) the following clauses:
(5A) The holder of a learner’s licence must not ride a motor
cycle on a public street if the motor cycle has an engine capacity
greater than 260 ml or a power to weight ratio greater than 150
kilowatts per tonne.(5B) Despite clause (5A), the holder of a learner’s licence who is the owner of a motor cycle with a power to weight ratio greater than 150 kilowatts per tonne rnay, until 1 March 1995, ride the
motor cycle if the motor cycle was acquired by the holder before
1 March 1993.
| (b) | by omitting from Regulation 12 (6) the matter “(5) or (8)” and by inserting instead the matter “(5), (5A) or (8)”; |

by omitting Regulation 12A (5) (b) and by inserting instead the following paragraph:
(b)
if it is a motor cycle—with an engine capacity greater than 260 ml or a power to weight ratio greater than 150 kilowatts per tonne; and
(d) by inserting after Regulation 12A (5) the following clause: (5A) Despite clause (5) (b), the holder of a provisional licence who is the owner of a motor cycle with a power to weight ratio greater than 150 kilowatts per tonne may, until 1 March 1995, ride the motor cycle if the motor cycle was acquired by the holder before 1 March 1993.
EXPLANATORY NOTE
The object of this Regulation is to amend the Motor Traffic Regulations 1935 to restrict the types of motor cycles which holders of learners’ or provisional licences may ride.
From 1 March 1993, the holder of a learner’s or provisional licence must not
ride a motor cycle which:
(a) has an engine capacity greater than 260 ml; or
(b) has a power to weight ratio greater than 150 kilowatts per tonne.
As a transitional measure, the restriction on the power to weight ratio will not apply until 1 March 1995 to the holder of a learner’s or provisional licence who owns a motor cycle which was acquired by the holder before 1 March 1993.
