TRAFFIC ACT 1909—REGULATION
(Relating to the registration and sale of motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended:
| (a) | by omitting from Regulation 13 the word “Commissioner” wherever occurring and by inserting instead the word “Authority” ; |
(b) by inserting after Regulation 13 (2A) the following clause:
(2B) The Authority may refuse registration of a motor vehicle, or renewal of any such registration, in more than 2 joint names, and may refuse to transfer any such registration to transferees in more than 2 joint names, whether the names are those of natural persons or bodies corporate.
| (c) | by inserting at the end of Regulation 13 (3) (f) the following matter: |
; or
(g)
a number-plate issued under these Regulations for use on the vehicle is surrendered to the Authority.
| (d) | by omitting Regulation 25 (1) (a) and by inserting instead the following paragraph: |
(a)
complete the form of sale notice printed on the cedficate of registration of the vehicle (or, where the certificate of registration is not available. a form of sale notice that

complies with clause (1A)) and deliver the completed notice to the purchaser or to the person to whom possession of the vehicle has passed; and
(e) by inserting after Regulation 25 (1) the following clause:
(1A) For the purposes of clause (1) (a), a form of sale notice complies with this clause if it specifies:
(a) the date on which the vehicle was sold or on which it passed from the owner’s possession; and
(b) the full name and address of the person who bought it or to whose possession it passed.
(f)
by omitting from Regulation 26 (1) (a) the word “Commissioner” and by inserting instead the words “Authority, in a form approved by the Authority,”;
(g)
by omitting from Regulation 26 the word “Commissioner” wherever occurring and by inserting instead the word “Authority”.
EXPLANATORY NOTE
The objects of this Regulation are:
(a) to limit to two the number of joint names in which a motor vehicle my be registered; and (b) to allow the registration of a motor vehicle to be cancelled on surrender of the vehicle’s number-plates; and (c) to specify the essential features of a notice of sale of a motor vehicle (that is, the notice required to be given to the Roads and Traffic Authority when a motor vehicle is sold or delivered into the possession of another person); and (d) to require a person who by purchase or otherwise acquires possession of a motor vehicle (and who is thereby required to apply for registration of the vehicle) to apply for registration in a form approved by the Authority.
