TRAFFIC ACT 1909—REGULATION
(Relating to the parking of a vehicle displaying a disabled person’s
parking authority)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 September 1992.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a)
by omitting Regulation 54 (4) (e) and by inserting instead the following subclause:
(e) “Authorised Disabled Person’s Vehicle” mean a vehicle:
(i) that is driven by, or is being used for the conveyance of, a disabled person; and
(ii) to which is affixed, in a manner directed by the Authority, a disabled person’s parking authority issued by the Authority and in force.
(b)
by omitting the definition of “disabled person’s parking authority in Regulation 54 (4A) and by inserting instead the following definition:

“disabled person’s parking authority” means an authority
issued by the Authority:
(a) to a disabled person; or
(b)
to an organisation for the purpose of conveying a specified disabled person or persons.
| (c) | by omitting Regulation 54 (11) and by inserting instead the following clause: |
(11) The driver of a motor vehicle that is displaying a disabled person’s parking authority in a manner specified in the authority and that is:
(a) driven by or used for the conveyance of the disabled person to whom the authority was issued; or (b) used for the conveyance of a disabled person or persons by the organisation to whom the authority was issued, may cause the vehicle to stand, wait or be parked otherwise than in accordance with a traffic control sign provided pursuant to clause (6) (a1):
(c)
for a period not exceeding 30 minutes if a parking time limit of less than 30 minutes applies; and
(d)
for a period not exceeding 2 hours if a parking time limit of 30 minutes applies; and
(e)
for any period if a parking limit of more than 30 minutes applies.
(d) by omitting Regulation 54 (12) (b).
EXPLANATORY NOTE
The object of this Regulation is to mend the Motor Traffic Regulations 1935 so
as to improve the existing disabled person’s parking authority scheme:
| (a) | by removing the requirement to nominate the vehicle or vehicles being |
driven by or used to convey the person with a disability; and
| (b) | by removing the distinction in parking the limits between a vehicle driven by a person with a disability and one used to convey sick a person; and |
| (c) | by allowing vehicles showing a disabled person’s parking authority to park |
