TRAFFIC ACT 1909-REGULATION

(Relating to the operation of road trains)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Traffic Act 1909, has been pleased to make the

Regulation set forth hereunder.

Commencement

1. This Regulation commences on 4 August 1995.

Amendment

2. The Motor Traffic Regulations 1935 are amended:

(a) by omitting Regulations 113A—113C;

(b) by omitting from Regulation 114 (1) the words “(not being a road train)” wherever occurring;
(c) by omitting from Regulation 114 ( 1) (a) the words “any articulated vehicle” and by inserting instead the words “a road train or any other articulated vehicle”;
(d) by omitting from Regulation 114 (1) (b) the words “any other motor vehicle” and by inserting instead the words “a road train or

any other motor vehicle”;

(e)

by omitting from Regulation 117Q (1) (a) the word “OVERSIZE” and by inserting instead the words “ “LONG VEHICLE”, “OVERSIZE” or “ROAD TRAIN” ”;

(f)

by omitting Regulation 130A (1) (f) (iv) and by inserting instead the following subparagraph:

(iv)  an offence arising under Regulation 114 (1) in respect of standing or driving a road train that is longer than 25 metres on a public street that is not an approved route according to the conditions of the relevant permission under Regulation 114 or of an overdimension permit under Part 9A;

(g) by omitting item 30 of Schedule A;

(h)

by omitting from Table A of Part 2 of Schedule K the matter relating to Regulation 113B (1) (a) and the matter relating to Regulation 113B (1) (b), 113B (2) and 113C (2);

(i)

relating to Regulation 114 ( 1 ) (a) and (b) and by inserting instead

by omitting from Table A of Part 2 of Schedule K the matter Regulation 114 (1) (a) or (b):

(a) in respect of the offence of standing or driving a

road train that is longer than 25 metres on a public street that is not an approved route according to the conditions of the relevant permission under Regulation 114 or of an overdimension permit under

Part 9A ............... 773
(b) in respect of any other offence ............... 61

EXPLANATORY NOTE

The object of this Regulation is to change the regime regulating the use of road trains. Currently, a person cannot stand or drive a road train upon public streets unless the person obtains a road train permit in respect of the road train from the Roads and Traffic Authority.

This Regulation prohibits road brains being stood or driven upon a public street

unless:

• written permission is obtained from the Commissioner for Police and all conditions

of that permission have been complied with; or

the road train is the subject of a specific overdimension permit issued under
Division 2 of Part 9A of the Motor Traffic Regulations 1935; or

• a general overdimension permit has been granted under Division 3 of Part 9A of the Motor Traffic Regulations 1935 authorising road trains (specifically or as part of a general class of motor vehicles) to be stood or driven on certain public streets.

This Regulation is made under section 3 (and in particular section 3 (1) (a) and (h))

of the Traffic Act 1909.
