TRAFFIC ACT 1909—REGULATION
(Relating to the operation of certain road trains)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 10 February 1995.
Amendment
2. The Motor Traffic Regulations 1935 are amended by omitting from Regulation 92AA (5) the words “does not include a road train or” and by inserting instead the words “includes a road train and”.
EXPLANATORY NOTE
The object of this Regulation is to allow road trains and any component vehicles of a road train that have a laden height exceeding 4.3 metres but not 4.6 metres to operate in certain parts of New South Wales without the need for an overdimension permit. Regulation 92AA of the Motor Traffic Regulations 1935 enables the Roads and Traffic Authority, by order published in the Gazette, to determine specific streets or areas in which motor vehicles that exceed the prescribed height may be stood or driven. This Regulation makes road trains a motor vehicle to which Regulation 92AA applies.
This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation-making power) and in particular section 3 (1) (a) and (h).
